The Ethics Commission conducts its meetings in accordance with the Maryland Open Meetings Act. The Act applies to a public body only when it is engaged in a legislative, quasi-legislative, or advisory function. The Act does not apply to the Ethics Commission when it meets to consider a complaint or a request for an advisory opinion, waiver, or secondary employment because consideration of these matters is an executive function under the Act. In addition, the Ethics Law requires the Commission to consider these matters in confidence. Therefore, although the Commission may provide public notice of a meeting, the meeting itself, or portions of the meeting, may not be subject to the Act. Even when the Commission is engaged in a function subject to the Act, the Commission may conduct all or part of that meeting in closed session as permitted by the Act.
