MCEO NO. 252-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Montrose Parkway West - CIP Project No. 500311.  The option contract dated August 2, 2005, between Loc Thanh Duong, Tam Ngoc Duong, and Montgomery County for the purchase of a portion of the property located at 6142 Stonehenge Place, Unit 1, Rockville, Maryland, is accepted.  The County Attorney is directed to take all necessary steps to acquire an easement.  Effective Date:  8/19/05.

 

MCEO NO. 253-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Montrose Parkway West - CIP Project No. 500311.  The option contract, dated August 4, 2005, between Allan Harris, Elaine Harris and Montgomery County for the purchase of a portion of 12111 Hitching Post Lane, Rockville, Maryland, is accepted.  The County Attorney is directed to take all necessary steps to acquire the property.  Effective Date:  8/19/05.

 

MCEO NO. 254-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Cashell Road Sidewalk (CIP 506747).  The County Executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Olney.  A public hearing was held on June 9, 2005, and the hearing examiner recommended approval of the project.  Consequently, the Director of the Department of Public Works and Transportation is authorized to proceed with the construction of a concrete sidewalk 5 feet wide, 7,250 feet long, which will conform to ADA requirements.  Cashell Road is classified as an arterial roadway with an 80 foot public right-of-way on the east side.  The sidewalk will be constructed with a 4' to 5' greenspace between the proposed sidewalk and edge of roadway.  The total estimated cost for the project is $163,728.00.  Effective Date:  8/22/05.

 

MCEO NO. 255-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Wheaton/Glenmont.  This order directs DPWT to INSTALL and/or REMOVE the following traffic and/or parking control devices:  INSTALL Stop on northbound Skymist Ter. at Leeds Hall Dr.  Effective Date:  8/24/05.

MCEO NO. 259-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Bethesda.  INSTALL Permit Parking Only 9 AM - 6 PM Monday - Friday, Brookdale on both sides of Baltimore Ave. between River Rd. and Merivale Rd., between Merivale Rd. and the road end northeast of Merivale Rd.  Effective Date:  8/24/05.

 

MCEO NO. 260-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  INSTALL No Parking Any Time on both sides of Waters Discovery Lane between Observation Dr. and Waters Discovery Ter.  Effective Date:  8/24/05.

 

MCEO NO. 261-05:  DEPARTMENT OF PERMITTING SERVICES - This order certifies that construction of the following named streets has been completed in accordance with all applicable provisions of the Montgomery County Road Construction Code as specified in the permit.  The materials used in the construction of these streets were tested and found to be in compliance with county specifications.  The streets are as follows:  Clear Smoke Road., Cornflower Road, Ashleigh Greene Road, Aspen Dale Court, Blue Moon Court, Thundercloud Road, Bright Plume Ter., Autumn Field Court, Autumn Rust Road, Crestmont Road,  Ashmeade Road, Carved Stone Court, (King's Crossing),  Effective Date:  8/30/05.

 

MCEO NO. 262-05:  FIRE AND RESCUE SERVICE - Fire Lane Establishment.  A fire lane has been established.  Fire and Rescue Service is thereby ordered to post fire lane signs and paint curb/pavement (painting optional) in the location specified.  When signs and paint work have been completed, this order will authorize the enforcement of this Fire Lane by appropriate police and fire officials.  Compliance with this order must be achieved within 30 days of receipt.  The fire lane is located at Maryland Place Townhomes - Keymar Way, Thomas Farm Rd., Tippet La., Marston La., and Transhire Rd.  Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign.  The fine for parking in a fire lane is $500.  Effective Date:  8/31/05.

MCEO NO. 271-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Taxicab Rates.  A designee of the County Executive conducted a public hearing on Thursday, September 15, 2005, at 6:30 PM, in the Executive Office Building, Lobby Level Auditorium, 101 Monroe Street, Rockville, Maryland  20850, to consider comments from the public and taxicab industry on recommended changes to the taxicab rates as proposed by the Taxicab Services Advisory Committee.  Copies of the proposed rate changes are available at the Montgomery County Department of Public Works and Transportation, Division of Transit Services 101 Monroe St., Rockville, Maryland  20850.  Effective Date:  9/07/05.

MCEO NO. 278-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Wheaton/Glenmont.  INSTALL Stop on Hillsdale Dr. for north and southbound traffic at Valley View Ave.  Effective Date:  9/09/05.

 

MCEO NO. 279-05:  DEPARTMENT OF LIQUOR CONTROL - Amendment to FY 06 Working Capital Requirement.  State law provides for the Director of the Department of Liquor Control, with the approval of the County Executive, to determine the amount of working capital required by the Department, retain from the Department's net profits the funds necessary to service DLC related debt and provide adequate working capital for the operation of the DLC.  Because of this State law, both the County Attorney and the Attorney General have advised that the determination of the amount of funds required for these purposes is within the exclusive province of the County Executive, and is not subject to the County budget process.  Due to actions that took place in '04 and '05, it is so ordered that the County Executive must amend the FY 06 Working Capital fund and its contribution to the County's General Fund to a total of $30,684,000 as Working Capital.  Effective Date:  9/23/05.

 

MCEO NO. 280-05:  DEPARTMENT OF LIQUOR CONTROL - Amendment to FY 05 Working Capital Requirement.  State law provides for the Director of the Department of Liquor Control, with the approval of the County Executive, to determine the amount of working capital required by the Department, retain from the Department's net profits the funds necessary to service DLC related debt and provide adequate working capital for the operation of the DLC.  Because of this State law, both the County Attorney and the Attorney General have advised that the determination of the amount of funds required for these purposes is within the exclusive province of the County Executive, and is not subject to the County budget process.  This request for transfer is to move money from FY 05 Operating Expense to Personnel Expense and Capital Outlay.  Therefore the total Working Capital is now $34,540,193.  Effective Date:  9/23/05.

 

MCEO NO. 281-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Maryland Route 108 Sidewalk - CIP Project No. 506747.  The option contract between Sandy Spring Monthly Meeting of the Religious Society of Friends and Montgomery County, Maryland, for the purchase of land and granting of perpetual easements for the Maryland Route 108 Sidewalk is accepted.  The County Attorney is directed to take all necessary steps to acquire the land and easements.  Effective Date:  9/19/05.

 

MCEO NO. 282-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Bethesda Bikeways and Pedestrian Facilities (CIP #500119).  A public hearing will be held before the County Executive's designee and this order changes the date noted in MCEO No. 251-05 (now rescinded), to 3:00 PM on Thursday, October 27, 2005, in the lobby level auditorium of the Executive Office Building at 101 Monroe Street in Rockville, Maryland  20850.  The purpose of the hearing is to consider a proposal to provide bikeway and pedestrian improvements along locations as identified by the 1994 Bethesda Central Business District Sector Plan within public ways located in Bethesda, Maryland.  Improvements at the intersection of Bethesda Ave. and Woodmont Ave. will include:  removal of the right turn channel from southbound Woodmont Ave. onto westbound Bethesda Ave.; expansion of  the existing pedestrian refuge island from 1730 square feet to 2890'square feet; provision of a 510 square foot area bump-out at the northwest corner of Bethesda Ave./Woodmont Ave. intersection; widening of existing 12' wide crosswalks to 16' crosswalks.; expansion of 4' wide handicap ramps to 6'wide landing; and modification of traffic signals to accommodate the new crossing distances.  Improvements to Norfolk Ave. between Rugby/Glenbrook Ave. to Woodmont Ave. include intersection bump-outs at the following intersections with the Woodmont Ave. - Rugby Ave/Glenbrook Ave., Auburn Ave., Del Ray Ave., Cordell Av., St. Elmo Ave., Fairmont Ave.; provision of 5-foot-on-road, class 2, bike lanes on both sides of Norfolk Ave.; modification of existing traffic signals with provisions for pedestrian countdown times.  Plans are available for examination in the Offices of DPWT, 101 Monroe St., Rockville, Maryland.  Total cost is estimated to be approximately $768,373.  No properties are considered to be specially benefited by the proposed improvements which are subject to assessments.  Effective Date:  9/20/05.
