MCEO NO. 140-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Maria Luz Portillo, Woodfield Road Extended, CIP No 500151. the option contract between the above named parties and Montgomery County for the granting of an easement for the Woodfield Road Extended project is accepted. The County Attorney is hereby directed to take all necessary steps to acquire the easements. Effective Date: 6/05/08

A public hearing was held before the County Executive (or his designee) at 3:00 pm on Wednesday, June 25, 2008 in the first floor auditorium of the Executive Office Building at 101 Monroe Street in Rockville, Maryland. The sidewalk construction site is within the Quince Orchard Knolls community located in Gaithersburg, Maryland within Election District 9. The purpose of this hearing was to consider a proposal to provide safer pedestrian travel by constructing a concrete sidewalk along the south side of Bunchberry Land and the east side of Bunchberry Court. The sidewalk construction site is within the Quince Orchard Knolls community located in Gaithersburg, Maryland within Election District 9. The purpose of this hearing was to consider a proposal to provide safer pedestrian travel by constructing a concrete sidewalk along the east side of the entire length of Apricot Lane. MCEO NO. 147-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Parkwood Residential Permit Parking Area. The Hearing Examiner concluded that criteria established in 31-48 of the Montgomery County Code has been satisfied to establish a Residential Permit Parking Area for the 4700 block of Saul Road as a result of the non-resident parking generated by Kensington-Parkwood Elementary School. The Hearing Examiner recommends establishment of the Parkwood Permit Parking Area be limited to the east side of Saul Road between Franklin Street and Oldfield Drive. Effective Date: 6/11/08
MCEO NO. 148-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Miguel A. Melendez and Francisca J. Melendez Woodfield Road Exteded, CIP No. 500151. The Option Contract between Miguel A. Melendez and Francisca J. Melendez and Montgomery County Maryland for the purchase of land for the above-referenced project is hereby accepted. Contract obtained in the amount of $21,932.00. The County Attorney is hereby directed to take all necessary steps to acquire the land. Effective Date: 6/23/08
MCEO NO. 149-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Nahid Elyassi Travilah Road, CIP No. 500101. The Option Contract between Nahid Elyassi and Montgomery County Maryland for the purchase of land and the granting of an easement for the above-referenced project is hereby accepted. Contract obtained in the amount of $54,177.00. The County Attorney is hereby directed to take all necessary steps to acquire the land and easement. Effective Date: 6/223/08
MCEO NO. 150-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Karen Kuker-Kihl Montrose Parkway West, CIP No. 500311 ALARF funds 316222. The Options Contract between Karen Kuker-Kihl and Montgomery County Maryland for the purchase of land and granting of easements for the above-referenced project is hereby accepted. The acquisition will be paid utilizing ALARF funds. Contract obtained in the amount of: $778,016.43. The County Attorney is hereby directed to take all necessary steps to acquire the land. MCEO NO. 157-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Condemnation Authorization, John C. Grimberg Trust, Nebel Street Extended, CIP No. 500401. Montgomery County and the property owner, John C. Grimberg Trust, have been unable to reach an agreement of the price to be paid for the County to acquire the property for the Nebel Street Extended Project. Montgomery County may institute condemnation proceedings to acquire property required for public use under �41-3 and �49-46 of the Montgomery County Code (2004), as amended. The County Attorney is hereby directed to acquire by condemnation the following described property, in its entirety for the Nebel Street Extended Project and related public use. Effective 2/01/08

A public hearing will be conducted by the County Executive or his designee at 1:00 pm on Monday September 15, 2008, in the first floor auditorium of the Executive Office Building at 101 Monroe Street in Rockville, MD 20850 to consider an application received from Shulman, Rogers, Gandal, Pordy & Ecker, on behalf of its client, 11250 Veirs Mill Road LLC, the applicant, seeking abandonment of a portion of Kensington Boulevard in the Kensington View Subdivision in Kensington. After the hearing, the Hearing Officer will report his or her findings and recommendations to the County Executive for further consideration. Effective Date: 7/11/08
MCEO NO. 175-08: DEPARTMENT OF FIRE AND RESCUE SERVICE - Authorizes the Fire Chief to designate employees assigned to the Montgomery County Fire and Rescue Service to solicit gifts for the benefit of the Muscular Dystrophy Association (MDA) as part of its "Fill the Boot" campaign. MCEO NO. 176-08: DEPARTMENT OF FIRE AND RESCUE SERVICE - Public Hearing - Fire Protection Systems - Fee Schedule for Inspections, Permits, Licenses, Certificates and Exceptions. A public hearing will conducted by the Fire Chief or his Designee at 1:00 pm on Friday, September 5, 2008, Fire Code Enforcement Section Main Conference Room, 255 Rockville Pike, 2nd Floor, Rockville, Maryland 20850 to consider amendments to existing Fire safety Code Regulation 5-06AM, Fee Schedule for Inspections, Permits, Licenses, Certificates and Exceptions, pertaining to increased fees or new fees to recover the costs of providing service, clarifying certain terms and billable inspections, authorizing the Fire Chief to enter into payment plans with clients, and allowing for the recovery of time committed to civil litigation. Written comments will be accepted through close of business September 19, 2008 and should be addressed to Assistant Chief Michael A. Donahue, Office of the Fire Marshal, 255 Rockville Pike, 2nd Floor, Rockville, MD 20850. After aforesaid Hearing, the Haring Officer will report his findings and recommendations to the Fire Chief or his Designee for further consideration as prescribed by County Code. A public hearing will be conducted by the County Executive or his designee at 3:00 pm on September 11, 2008, in the first floor auditorium of the Executive Office Building at 101 Monroe Street in Rockville, MD 20850 to consider a proposal to construct and improve the 13,800 feet of bikeway along MacArthur Boulevard from I-495 to Oberlin Avenue The purpose of this hearing is solely to obtain public comments to assist the County Executive in determining whether or not to authorize this project.
