MCEO NO. 028-11: DEPARTMENT OF TRANSPORTATION - Henderson Avenue Storm drain and Roadway Improvements (CIP #501108). The County Executive hereby finds that public interest requires the construction of a storm drain system and roadway improvements along Henderson Avenue from Georgia Avenue to its terminus in Wheaton Regional Park, located in the 5th Election District, as follows: modify the profile of Henderson Avenue and convert the open-section roadway to a closed-section roadway by installing curb and gutter along both sides of the road. The proposed roadway will have a 25-foot wide closed section. The total length of roadway improvements is approximately 2,600 linear feet. Provide more than 4,550 linear feet of curb and gutter; install new storm drain inlets and 2,020 linear feet of storm drain pipes. Reconstruct the roadway pavement to facilitate proper drainage. A public hearing was held before the County Executive (or his designee) on Wednesday, June 16, 2010. Estimated cost of the proposed improvement and funding allocations thereof are as follows: $0.00 Costs to be assessed for special benefit against applicable properties; $74,760.00 Cost to be borne by WSSC as their share of system facility adjustment expenses; $ 0.00 Cost to be borne by Federal Aid; $2,195,240.00 Costs not otherwise incurred, to be borne by Montgomery County; $2,270,000.00 Total estimated cost of the project, including construction management and inspections, land acquisition, utilities, site improvements, and construction. Unless otherwise approved by the County, expenditures authorized by this Order plus expenditures accrued to date for this project shall not exceed $2,270,000.00 and shall be made payable from funds appropriated for CIP Project No. 501108.

MCEO NO. 029-11: DEPARTMENT OF TECHNOLOGY SERVICES/OFFICE OF CABLE AND COMMUNICATION SERVICES - Transfer of Interest of Equity of Starpower Communications, LLC. On August 3, 1999, Montgomery County and Starpower Communications, L.L.C. ("Starpower") entered into a franchise agreement granting Starpower the right to occupy County right-of-way to provide cable service in the County. At that time, Starpower was a subsidiary of RCN Corporation ("RCN"). In March 2010, RCN proposed to transfer ownership and control of Starpower to Yankee Cable Acquisition, LLC ("Yankee"). Yankee, in turn, was controlled, through several intermediate wholly-owned subsidiaries, by ABRY Partners VI, L.P. ("ABRY Partners"). The County reviewed that proposed transfer and the qualifications of the new owners, held a public hearing, and ultimately approved the transfer. The transfer of control occurred in the latter half of 2010. On or about November 2, 2010, Starpower and Yankee filed with the County an application for transfer of interest, in which they proposed to add three private equity investors, Spectrum Equity Investors (19.7% to be held by two different limited partnerships), and HarbourVest Partners ( 5.4% to be held by three different limited partnerships), and New York Life Capital Partners (6.6% to be held by six different limited partnerships), who will make minority equity investments in one of the wholly-owned subsidiaries of ABRY - a company called Yankee Cable Partners, 'LLC' ("YCP") - that owns an equity interest in Starpower. The proposed minority investment in YCP will not result in a change of control of Starpower, but does constitute a transfer of an interest in a franchisee under Chapter 8 of the Montgomery County Code. Under federal law, the County is required to act on a transfer application within 120 days, unless the parties agree to extend the deadline. The County has authority under both federal and County law to review the qualifications of the parties, and the past performance of the franchisee before approving a requested transfer. The County may also consider whether the transfer of an interest will effect the franchisee's operation of the system or the public interest. The County reviewed the application for transfer and conducted a public hearing on the proposed transfer on February 18, 2010. At the public hearing, Todd Wells, a Yankee Cable representative, spoke. There were no other speakers and no objections to the approval of the transfer. The County Executive hereby finds that the transfer of interest will not adversely affect the operation of the system and it is in the public interest. This finding is based upon the representations of the franchisee and the parties to the transfer of interest. Should the County become aware of information that these representations were inaccurate; the County reserves the right to take appropriate action. Therefore, the County Executive hereby approves the transfer of interest in the equity owner of Starpower. This approval is conditioned upon the franchisee's continued compliance with the franchise agreement and the applicable law. Effective Date: 3/01/11
MCEO NO. 030-11: DEPARTMENT OF ECONOMIC DEVELOPMENT - Establishment of the Building Lot Termination Program's Base and Maximum Easement Value for FY2012. Chapter 2B of the Montgomery County Code establishes a building lot termination (BLT) easement program for the purpose of purchasing easements to limit development and preserve agricultural land in the RDT Zone. Section 2B.00.01.04D(1) of the Code of Montgomery County Regulations (COMCOR) provides that the County Executive will, by July 1st of each year, determine the base value, or base purchase price, and the maximum value, or maximum purchase price, of BLT easements for that fiscal year. It is ordered that for Fiscal Year 2012 a parcel of agricultural land in the RDT Zone with at least one TDR and an individual on-site sewage waste disposal system is $375,000; the base value of a BLT easement is $225,000 (60% of the fair market value); and the maximum value of a BLT easement is $262,500 (70% of the fair market value). MCEO NO. 037-11: DEPARTMENT OF TRANSPORTATION - Century Boulevard (CIP #501115). Order for the construction and improvement to the extension of Century Boulevard a public way, located in Germantown, Maryland within Election District 2. The Director of the Department of Transportation is herby authorized to proceed with the construction of a new four lane divided, closed section roadway from its current terminus south of Oxbridge Tract to its intersection with future Dorsey Mill Road a distance of approximately 2,600 feet. The new road will be constructed below Father Hurley Boulevard at the existing bridge crossing. Construction includes a new three cell pipe arch culvert at the exiting stream crossing, construction of 5 feet concrete sidewalk along east side, and 8-foot bikeway along west side, and construction of storm drainage and storm water management facilities. A public hearing was conducted 1/14/2008 and the Hearing Examiner recommended approval of the project. At the time of the public hearing the Century Boulevard project was funded under Subdivision Road Improvement CIP No. 508000 and now is funded under CIP No. 501115. The County Executive hereby proposes that the total cost of the project, to be determined by final accounting after construction has been completed, shall be distributed in the approximate amounts as follows: $0.00 costs to be assessed for special benefit against applicable properties, $0.00 cost to be borne by WSSC as their share of system facility adjustment expenses, $9,312,000.00 cost to be borne by Montgomery County $4,000,000.00 costs to be borne by Developers $13,312,000.00 total estimated cost of the project, including engineering, land acquisition, site improvements and construction. Unless otherwise approved by the County, expenditures authorized by this Order plus expenditures accrued to date for this project shall not exceed $13,312,000.00 and shall be made payable from funds appropriated for CIP Project No. 501115.
