MCER NO. 14-08: PROPOSED DEPARTMENT OF CORRECTION AND REHABILITATION

REGULATION - Alternative Community Services Fee

SUMMARY: The proposed regulation provides for a sliding fee schedule for program  participants of $50 to $175.  The present fee is $150.  The proposed regulation would supersede Executive Regulation

82-92.

MCER NO. 15-08:  PROPOSED DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION   REGULATION - Residential Waste Estimates for System Benefits Charges

SUMMARY:  Montgomery County Code 2004, Section 48-8A(b)(2)(A)provides that the County Executive must, each fiscal year, establish by Method  2 executive regulation, an estimate of the amount of solid waste generated per dwelling unit.  This regulation updates the per-household waste generation estimates used to calculate residential System Benefit Charges.  The proposed regulation would supersede Executive Regulation 15-08.

MCER NO. 17-08:  PROPOSED DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION REGULATION - Development Impact Tax for Transportation

SUMMARY:  The proposed regulation updates the existing regulation that became effective in 1991.  It provides standards on the implementation of Chapter 52 of the County Code and establishes the process for the implementation of the Code.  The proposed regulation would supersede Executive Regulation

34-90.

MCER NO. 18-08:  PROPOSED DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION REGULATION - County Solid Waste Collection Subdistricts

SUMMARY:  The proposed regulation modifies the method by which the County transfers collection service designation for single-family residential properties between those to receive both County recycling and refuse collection service and those to receive County recycling collection service only.

MCER NO. 19-08:  PROPOSED DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION REGULATION - Development Impact Tax for Public Schools

SUMMARY:  The proposed regulation provides standards, guidelines and establishes the process by which the Development Impact Tax (Chapter 52 of the County Code) is implemented for Public Schools.  The existing regulations for Development Impact Tax only related to Transportation.  The Impact Tax was expanded to include Public Schools in October 2003.  This regulation is to support that portion of the Code pertaining to Public Schools (Sections 52-87 through 52-94.  The proposed regulation would supersede Executive Regulation 34-90.
