#302-G, Middlebrook Commons Townhouse Association v. Medlin (April 30, 1996) (Panel: McLeod, Auvil, Simon)

The homeowner association (HOA) complained that the homeowner (HO) violated the community rules by failing to maintain his deck in good condition.

The evidence at the hearing showed that the HO's second-floor deck was missing two of its three railings and part of the third; that the HOA's Declaration requires all unit owners to maintain their homes in good condition; that the deck was found to be in violation of the Montgomery County housing code; and that the HO did not file any answer to the complaint and did not attend the hearing.

The hearing panel found that the HO was in violation of the community rules and ordered the HO to repair or remove the deck within 30 days.
