Registration Instructions
All Montgomery County condominium, cooperative, and homeowner associations MUST register and pay an annual fee to the Commission on Common Ownership Communities through the Department of Housing & Community Affairs.
The registration requirement DOES NOT APPLY to communities located within the limits of certain incorporated municipalities: City of Gaithersburg, Town of Garrett Park, Town of Laytonsville, Town of Poolesville, Town of Somerset, and Town of Washington Grove. To determine if registration requirements apply, a community should contact the Commission on Common Ownership Communities at (240) 777-0311.
Registration and Annual Renewal
- Any changes to the community’s governing body or managing agent must be updated annually. The Board President must sign the registration application; an agent's signature is not acceptable.
- Current governing documents and a complete list of the street addresses of units in the community must accompany the application. Any amendments to the governing documents must be uploaded to the community’s account as soon as they are adopted.
- A separate list of all rental units within the community, their street addresses and apartment numbers, must accompany the application, and must be updated annually.
- Montgomery County does not consider “family-occupied” units as rentals for the purposes of licensing. “Family” is defined as only the grandparents or parents, siblings, children or grandchildren of the non-resident owner.

The Fees
- Once a community is registered, the Licensing & Registration unit will automatically generate a renewal notice each year.
- Registration fees are to be paid for each Fiscal Year (July 1 through June 30) based on the number of units built and sold by the end of the Fiscal Year. Fees are not prorated.
- When construction is ongoing or property is being converted from multi-family rentals, current Fiscal Year Registration Fees should be based upon the best possible estimate.
