Establishes an Intellectual and Developmental Disabilities Commission, prescribes the membership and duties of the Commission. Provides for the staffing of the Commission, and generally amends the law regarding the provision and coordination of services for individuals with intellectual and developmental disabilities in the County.

Limits the inquiries allowed by the County regarding certain health information of prospective employees; prohibits consider an applicants’ abortion care, miscarriage, contraception, sterilization, pregnancy, and family planning for employment decisions. Allows for the County to request or seek business-related healthcare information solely to determine whether an applicant meets a minimum qualification.

Bill 11-22 - Buildings – Lactation Rooms in County Buildings – Required
Require County buildings to include a lactation room for County employees or provide alternative accommodations; require employees to receive break time for lactation needs; require the County Executive to establish personnel regulations for certain accommodations; require certain educational materials posted on the County’s website; and generally, amend the law regarding buildings and personnel regulations. -

Bill 42-21 - Child Care – Early Care and Education Coordinating Entity
Require the Council to designate a non-profit corporation to serve as the County’s Early Care and Education Coordinating Entity. Designating an independent nonprofit entity with parents, employers and providers as key stakeholders will ensure community priorities are reflected in building a robust system that supports all residents having access to high quality, affordable early care and education. -
Bill 29-19 Health and Sanitation – Electronic Cigarettes – Distribution
Prohibit an electronic smoking devices manufacturer from distributing electronic cigarettes to retail stores within a certain distance of certain schools; and (2) generally amend County law regarding smoking, electronic cigarettes, and health and sanitation. -

Bill 11-24 - Finance - Economic Development Fund - Make Office Vacancy Extinct (MOVE) Grant Program
Establishes a business incentive grant program under the Economic Development Fund to support eligible businesses with the rental costs of locating, relocating or expanding office space in the County. Codifies incentives for new businesses relocating to the County currently provided under the make office vacancy extinct (MOVE) pilot grant program. Provides incentives to new and existing businesses expanding operations in the County, sets eligibility criteria for businesses qualifying for the program incentives, and generally amends the laws regarding finance and economic development.

Establishes a Montgomery County Community Reinvestment and Repair Fund Commission. Modifies the calculations for tax rate adjustments for transportation improvements by requiring cumulative increase or decrease in the construction cost index rather than an annual average every two years. Sets a cap on the development impact tax rate for school and transportation improvements. Allows certain carryover increases of the biennial tax rate adjustments, and generally amends the law governing transportation and school development impact taxes.

Alters the administration and eligibility requirements of the Small Business Innovation Research and Small Business Technology Transfer Matching Grant Program. Determines the criteria for a business to be eligible for the matching grant, the maximum amount of grant funds a business can receive under a SBIR or STTR Phase I or Phase II grant, and the total number of County matching grants businesses can receive each year.

- Resolution 20-214 - Development Impact Tax Rates for Transportation and Public School Improvements
Development Impact Taxes are assessed on new residential and commercial buildings and additions to commercial buildings in the county to fund, in part, the improvements necessary to increase the transportation or public-school systems capacity, thereby allowing development to proceed.

Allow a qualified investor to receive the cybersecurity investment incentive tax credit supplement; and generally amend the law related to the cybersecurity investment incentive tax credit supplement. -

Would suspend the imposition of the carryout bag tax until 15 days after the conclusion of the Maryland state of emergency. Within 7 days after the state of emergency ceases, Bill 17-20 would require the County Executive to notify retail establishments and the public of the date on which the imposition of the carryout bag tax will resume. -

The Homeowner Assistance Program provides grants or loans for delinquent mortgage payments, past due association fees and past due real estate taxes - as well as for home repairs and energy efficiency improvements. Eligibility is based on income and COVID impact; owner occupancy is required.

Establishes a 100 percent payment in lieu of taxes (PILOT) for a housing development owned or controlled by the Housing Opportunities Commission (HOC) or a nonprofit housing developer with at least 50 percent of the dwelling units affordable to households earning 60 percent or less of area median income. Bill 26-21 also repeals the annual maximum aggregate amount of all PILOTs approved under this law, which historically was not permitted to exceed an amount set annually by Council resolution for the following 10-year period.

Renames “Accessory Apartments” to “Accessory Dwelling Units” (ADU) in the County Code, modernizes the standards for measuring basement ceiling heights, requires ADU applicants to certify that they meet any applicable HOA standards and notice requirements to affected HOAs, requires quarterly reporting on ADU issues by the County Executive, and requires that the property owner live on-site in either the principal dwelling or the ADU. Companion legislation to ZTA 19-01.

OPT/SLT Bargaining Units - Pension and Retirement Adjustments
Extends from January 4, 2024, to August 7, 2024, the deadline for eligible County employees enrolled in Groups E and J of the Employees’ Retirement System to elect to purchase credited years of service with their existing Retirement Savings Plan or Guaranteed Retirement Income Plan balances, and generally amends the law regarding the Employees’ Retirement System. - Bill 1-23 - Property Tax Credit – Individuals 65 and Above and Retired Military Services Members – Amendments
Amends the property tax credit for individuals 65 and above who have resided in the same dwelling for the preceding 40 years. The maximum assessed value of the property must be $700,000 at the time the individual applied for the credit. The property tax credit also applies to retied members of the uniformed services, or their surviving spouses who are over the age of 65 and not remarried. For retired military service members, the maximum assessed value of the property is $550,000.

Would establish a County property tax credit for a full-time sworn police officer, firefighter, emergency medical technician, or a public safety emergency communications specialist employed by the County. The purpose of the Bill is to increase the number of County employees occupying these positions who reside in the County and help recruit and retain these employees. -
Bill 43-20 - Non-merit Employees - Merit System Employees - Severance Pay
Would prohibit severance pay for a County employee unless authorized by law and prohibit severance pay for certain employees who violate the Ethics Law. -
Bill 42-20 - Ethics - Public Accountability and Transparency - Amendments
Require the Executive to disclose a proposed employment contract with an appointee to a non-merit position and any employment contract with an employee currently serving in a non-merit position to the Council; include the sale or promotion of certain intellectual property by a public employee as other employment; prohibit a public employee who has received compensation from an individual or organization in the previous 12 months from participating in a procurement with that individual or organization; require a public employee who participates in a procurement process with an individual or organization seeking to do business with the County that compensated the public employee for services performed more than 12 months before the participation began to disclose the prior relationship to the Procurement Director; require an elected official or non-merit employee to disclose, with some exceptions, the source of each fee greater than $1,000 received for services in a financial disclosure statement; and prohibit the Chief Administrative Officer from engaging in other employment. -
Bill 40-20E - Uniform Trader's License Fee
Would select a uniform trader’s license fee of $15 within the unincorporated parts of the County. This selection is authorized under Section 17-1807.1 of the Business Regulation Article of the Maryland Code. -
Bill 31-20 - Public Campaign Financing - Amendments
Amend the County public campaign financing system; • alter the maximum contribution limits; allow participating candidates to carryover certain funds under certain circumstances; require an audit of the public campaign financing system after the general election in an election cycle; and alter the penalties for willful violations of the public campaign financing system. -
Bill 29-20 - Taxation - Payments in Lieu of Taxes - WMATA property
Would require the Director of Finance to offer a payment in lieu of taxes for a residential or commercial high-rise building constructed by a private developer on property leased from the Washington Metropolitan Area Transit Authority (WMATA) at a Metro Station. The Bill would require the payment in lieu of taxes that would exempt 100% of the real property tax that would otherwise be levied for a period of 15 years beginning in the year a use and occupancy permit is issued for the qualifying development. -

Authorize the Inspector General to hire one or more deputies as a term merit employee; authorize the Inspector General to hire other staff of the Office as a merit employee; and generally amend the law governing the staff of the Inspector General. -
