How it Works

Permits must be applied for via paper application. You may submit in person at DPS offices during normal business hours or by mail. A non-refundable permit fee must be paid at application. Acceptable methods of payment are credit card, check and cash. Cash and credit card is only accepted if paid in person.

How it Works

The applicant submits a formal request which is reviewed by DPS staff against the criteria for nonconforming use contained in the Zoning Ordinance. Documentation such as sales receipts, tax records, signed affidavits and photographs provide evidence which is considered during the decision-making process. The applicant is informed in writing of the decision on their request. The following documents must be included with the application:

• Name and addresses of adjoining and confronting property owners; (identify location of each property owner on the location map.
• Location map with site identified.
• Site plan to scale showing the location of all structures and parking
• Current photographs of the property including all structures.
• Evidence sufficient to establish that the use was lawful when established and continues to be lawful, even though it no longer conforms to the requirements of the zone in which it is located because of zoning ordinance or zoning map changes.
• Evidence sufficient to show continuous use since initial establishment of the lawful use

How it Works

Once your information is submitted DPS personnel will begin the review process. Upon discovery of errors, omissions or non-compliant information the project is returned to the applicant so that the necessary corrections can be made and the information resubmitted to DPS. Once the review is completed the project is forward to a DPS permit technician for permit issuance. The normal processing time is ten days for a complete application submission.
