Nonconforming Use Certificate APPLICATION AND REVIEW PROCESS
The term “nonconforming” applies to a land use which existed prior to the establishment of the zoning in a geographic area, or a change in zoning which makes the use no longer in compliance with the Zoning Ordinance.
What is a nonconforming use?
The use of property that was allowed under the zoning regulations at the time the use was established but which, because of subsequent changes in those regulations, is no longer a permitted use.
Can a nonconforming use become larger or more extensive?
No, the nonconforming use of a structure or lot cannot expand as noted in Section. 7.7.2.A of the Montgomery County Zoning Ordinance.
