MCEO NO. 40-07:  FIRE AND RESCUE SERVICE - Fire Lane Establishment.  This order is notification of the establishment of a fire lane at Sugarloaf Congregation of UUS, 19613 Germantown Road..  The department is hereby ordered to post fire lane signs and paint curbs/pavement (painting optional) in the location listed above.  When signs and paint work have been completed, this order will authorize the enforcement of this fire lane by appropriate police and fire officials.  Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign.  The fine for parking in a fire land is $250.00.  Effective Date:  02/12/07.

 

MCEO NO. 51-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Briggs Chaney Road East of U.S. 29 - CIP No. 509942.  The option contract between Robey Road Property Partnership and Montgomery County, Maryland, for the purchase of land for the Briggs Chaney Road East of U.S. 29 Improvements is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the easement.  Effective Date:  2/6/07.

 

MCEO NO. 52-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Quince Orchard Road - CIP No. 500502.  The option contract between Betsey Hebron and Montgomery County, Maryland, for the granting of an easement for the Quince Orchard Road Improvements is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the easement.  Effective Date:  2/6/07.

 

MCEO NO. 53-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Travilah Road Improvements - CIP No. 500101.  The option contract between Mohammad Palizkar and Roya Jaseb and Montgomery County, Maryland, for the granting of an easement for the Travilah Road Improvements is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the easement.  Effective Date:  2/6/07.

MCEO NO. 61-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Quince Orchard Road - CIP No. 500502.  The option contract with Jorge Adalberto Diaz Gonzalez, and Montgomery County Maryland for the granting of an easement for the Quince Orchard Road project for the agreed upon amount is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the easement.    Effective Date:  2/6/07.

 

MCEO NO. 62-07:  DEPARTMENT OF ECONOMIC DEVELOPMENT - Designation of Parcel P-936 as a Strategic Economic Development Project.  On September 14, 2004, the Board of Education adopted Resolution Number 536-04 declaring Parcel P-936 as a surplus property.  If any land, school site, or building is no longer needed for school purposes, it shall be transferred to the County, as mandated in 4-115 of the Education Article of the Maryland Code.  The approved decision memo dated March 27, 2006 and the County Council concurrence dated July 24, 2006, recognizes Parcel P-936 a matter of significant interest to the County's economic development strategy.  Executive Regulation 31-97, Disposition of Real Property, exempts property of significant or strategic interest to the County's economic development plan from certain procedures associated with the disposition of real property.  It is, therefore, ordered that Parcel P-936 be considered a strategic economic development property as provided in Executive Order Regulation 31-97, and that such Parcel be transferred be deed to the City of Gaithersburg.  Effective Date:  2/14/07. 

 

MCEO NO. 63-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Wheaton/Glenmont.  INSTALL No Parking Any Time around the perimeter of the cul-de-sac island at the terminus of Harvest Lane south of Piping Rock Dr.  Effective Date:  2/6/07.

 

MCEO NO. 64-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Street Acceptance.  This certifies that the construction of the following named.streets has been completed in accordance with all applicable provisions of the Montgomery County Road Construction Code as specified in the permit.  The materials used in the construction of these streets were tested and found to be in compliance with County specifications:  Hollow Crest Dr. in Ashley Hollow; Golden Eagle Ct. in Silverwood; Tapwood Rd. in Hoyles Mill Village and Millenium Ct. in Mary J. MCEO NO. 65-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Condemnation Authorization - Athens Michael, Silver Spring Library CIP No. 710302.  Montgomery County needs to acquire a real property interest from Athens Michael in connection with the Department of Public Works and Transportation, Silver Spring Library project, CIP No. 710302.  The County and the owners of said property have been unable to agree upon a sum to be paid for the property and Montgomery County may institute condemnation proceedings under Section 49-46 of the Montgomery County Code 2004.  Therefore, the County Attorney is directed to acquire by condemnation the property needed by the County for the Silver Spring Library project.  Effective Date:  2/13/07

MCEO NO. 69-07:  DEPARTMENT OF FINANCE - Approving the Issuance of Colorado Health Facilities Authority Revenue Bonds.  The Global Country of World Peace, an organization described in Section 501(c)(3) of the Internal Revenue Code of 1986 (the "Code"), has advised Montgomery County, Maryland that the Corporation has requested that the Colorado Health Facilities Authority participate in the issuance of one or more series of revenue bonds in an aggregate principal amount not to exceed $51,000,000 to be used as follows: (i) Regional peace center facilities to be located on approximately 450 acres at 137 Waldemere Road, Livingston Manor, New York; on approximately 1160 combined acres at 20043 70 Road, Lebanon, Kansas, and 17022 100.Road, Smith Center, Kansas; on approximately 668 acres at 160 Echota and Old Fort Road, Asheville, North Carolina; on approximately 522 acres at Lost Valley Road, 1000' southeast of the corner of Blackwood Drive and Canebrake Road, Boulevard, California; on approximately 52 acres at 21650 Ballenger Road, Cedarpines Park, California; (ii) local peace center facilities at the approximately three acres adjacent to the northern boundary of 1068 Elkton Drive, Colorado Springs, Colorado; 5504 Edson Road, N. Bethesda, Maryland; 380 Parkland Plaza, Ann Arbor, Michigan; 399 Ruth Street S., St. Paul, Minnesota; 968 154th Street, Pleasant Dale, Nebraska; 1929 Greentree Road, Cherry Hill, New Jersey; 9450 Transit Road, E. Each local peace center or related facility will consist of an other officers, officials and employees of the County as the County Administrative Officer or the Director of Finance shall designate, are authorized hereby to do any and all things, execute all instruments, documents and certificates, and otherwise take all action  necessary, proper, or expedient in connection with this approval of the Bonds and the County Project for purposes of satisfying the requirements of Section 147(f) of the Code.  Effective Date:  2/15/07.

 

MCEO NO. 70-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of Portions of  Douglas Avenue, Carroll Knolls Subdivision, Kensington.  A public hearing was held before the Hearing Examiner at 10:30 AM on Thursday, April 19, 2007, in the Lobby Auditorium of the Executive Office Building, 101 Monroe St., Rockville, Maryland, 20850, to consider an application received from Holland & Knight, on behalf of Kaz Brothers L.C.  The applicant was seeking abandonment of portions of Douglas Avenue in the Carroll Knolls subdivision of Kensington.  The Hearing Officer reported his findings to the County Executive.  Effective Date:  2/21/07.

 

MCEO NO. 71-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of Portions of Evans Drive, Carroll Knolls Subdivision, Kensington.  A public hearing was held before the Hearing Examiner at 10:40 AM on Thursday, April 19, 2007, in the Lobby Auditorium of the Executive Office Building, 101 Monroe St., Rockville, Maryland, 20850, to consider an application received from Holland & Knight, on behalf of Kaz Brothers L.C.  The applicant was seeking abandonment of portions of Evans Drive in the Carroll Knolls subdivision of Kensington.  The Hearing Officer reported his findings to the County Executive.  Effective Date:  2/21/07

MCEO NO. 75-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Condemnation Authorization -  Parcel P909, Tax Map Grid EW21, North County Depot.  Montgomery County needs to acquire a real property interest for the construction of the North County Depot project.  The County and the owners of said property have been unable to agree upon a sum to be paid for the property, and Montgomery County may institute condemnation proceedings under Section 49-46 of the Montgomery County Code 2004.  Therefore, the County Attorney is directed to acquire by condemnation the property needed by the County for the North County Depot project.  Effective Date:  2/23/07.

 

MCEO NO. 76-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Condemnation Authorization - Parcel P800, Tax Map Grid EW21, North County Depot.  Montgomery County needs to acquire a real property interest for the construction of the North County Depot project.  The County and the owners of said property have been unable to agree upon a sum to be paid for the property, and Montgomery County may institute condemnation proceedings under Section 49-46 of the Montgomery County Code 2004.  Therefore, the County Attorney is directed to acquire by condemnation the property needed by the County for the North County Depot project.  Effective Date:  2/22/07.

 

MCEO NO. 77-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Travilah Road - CIP No. 500101.  The option contract with Ruey L. Lewis et al, Trustees and Montgomery County Maryland for the granting of an easement for the Travilah Road project for the agreed upon amount is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the easement.  Effective Date:  2/22/07.

 

MCEO NO. 78-07:  OFFICES OF THE COUNTY EXECUTIVE - Creation of BRAC Implementation Committee.  The adoption of the 2005 Base Realignment and Closure (BRAC) Commission Final Report into Public Law will realign some military medical activities currently located at the Walter Reed Army Medical Center (WRAMC) in D.C. will be relocated to the National Naval Medical Center (NNMC), to be renamed as the Walter Reed National Military Medical Center (WRNMMC) in September 2011. This realignment will result in the addition of approximately 1,200 hospital staff to Montgomery County, and a potential increase of over 400,000 patients and visitors to the base each year. The Department of Defense Office of Economic Adjustment (OEA) administers the Defense Economic Adjustment Program and may assist local governments in planning community adjustments required by the expansion of the military installation. OEA recommends that the affected local governments establish a single community task force to identify community impacts from the expansion, as well as coordinate initial assessments of important BRAC-related community issues.  For this reason, the BRAC Implementation Committee was established on February 23, 2007.  The Task Force will serve as a clearinghouse for timely
and accurate information on the BRAC expansion project at the NNMC campus; provide leadership and build consensus within the community to coalesce diverse interests and address stakeholder issues; provide an opportunity for interaction and information sharing among representatives of the military, the government, and the residents; insure that all issues with community impact are addressed in a comprehensive planning context; insure that impacts on the community are adequately addressed, and quality of life is maintained for NNMC employees, patients, visitors and neighbors and coordinate federal, state and local regulatory and funding efforts to insure that appropriate resources are used to achieve community goals. The Task Force will be composed of agency representatives, and community representatives. State and local elected officials, as well as military representatives, will be appointed as ex-officio members.  The Implementation Committee is expected to complete its work no later than September 15, 2011, which is the date by which the BRAC implementation is mandated to be complete.  Effective Date:  2/23/07.

 

MCEO NO. 79-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Sioux Lane Sidewalk - CIP No. 506747.  A public hearing was held at 4:30 PM on March 20, 2007, in the Lobby Level Auditorium of the Executive Office Building, 101 Monroe St., Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the south side of Sioux Lane from Longdraft Rd. to Raven Rock Dr. located in Gaithersburg, Maryland.  The project provides a sidewalk 4' wide and will conform to the ADA requirements.  The total length of the sidewalk is 1150 linear feet. Sioux Lane is classified as a secondary residential roadway and has a 60' public right-of-way. The existing roadway is approximately 26' wide. On-street parking is allowed on both sides of the roadway. There is approximately 17' of available public right-of-way on the south side of Sioux Lane. The sidewalk will be constructed with a variable width green space between the sidewalk and edge of roadway. Every effort will be made during construction to cause minimal disturbance within the public right-of-way.  Estimated cost of the proposed improvement and estimated funding allocations are as follows:  construction costs - $40,000.00; administrative and construction inspection costs - $4,000.00; total estimated cost of the project, including engineering site improvements and construction - $44,000.00.  Effective Date:  2/23/07.

 

MCEO NO. 80-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Claybrook Drive Sidewalk - CIP 506747.  A public hearing was held at 4:00 PM on March 20, 2007, in the Lobby Level Auditorium of the Executive Office Building, 101 Monroe St., Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the west side of Claybrook Dr. from Lamberton Dr. to 129 Claybrook Dr. located in Silver Spring, Maryland.  The project provides a sidewalk 4' wide and will conform to the ADA requirements.  The total length of the sidewalk is 1415 linear feet. Claybrook Dr. is classified as a secondary residential roadway and has a 60' public right-of-way. The existing roadway is approximately 26' wide. On-street parking is allowed on both sides of the roadway. There is approximately 17' of available public right-of-way on the west side of Claybrook Dr.  The sidewalk will be constructed with an eleven foot green space between the sidewalk and edge of roadway.  Every effort will be made during construction to cause minimal disturbance within the public right-of-way.  Estimated cost of the proposed improvement and estimated funding allocations are as follows:  Construction costs - $38,000.00; Administrative and construction inspection costs - $3,800.00; total estimated cost of the project, including engineering site improvements and construction - $41,800.00.   Effective Date:  2/23/07.
