MCER NO. 5-06:  PROPOSED FIRE AND RESCUE SERVICE REGULATION -  Fire Safety Code - Fee Schedule for Inspections, Permits, Licenses, Certificates and Exceptions

SUMMARY:  The proposed regulation provides a schedule for regular inspections as required by the Montgomery County Fire Safety Code, Section 22-23, establishes operational permits for the fire protection systems, license requirements to work on fire protection systems and fees for such inspections, permits and licenses, and revises existing fees for inspection services, permits, licenses, certificates and exceptions.  The proposed regulation would supersede Executive Regulation 28-03.

MCER NO. 6-06:  PROPOSED FIRE AND RESCUE SERVICE REGULATION - Fire Safety Code - Fire Protection Systems

SUMMARY:  The proposed regulation adopts, amends, and/or updates certain editions of the National Fire Codes and Standards related to fire protection systems.  This regulation applies to all buildings and structures within Montgomery County's jurisdiction.  The proposed regulation would supersede Executive Regulation 10-97.

MCER NO. 7-06:  PROPOSED FIRE AND RESCUE SERVICE REGULATION - Fire Safety Code - Building Construction

SUMMARY:  The proposed regulation adopts, and amends certain National Fire Codes and Standards related to life safety.  The proposed regulation would supersede Executive Regulation 22-98AM.

MCER NO. 9-06:  PROPOSED DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION REGULATION - Security Interest for Taxicab Passenger Vehicle Licenses

SUMMARY:  The proposed regulation establishes conditions for the creation of a security interest in a taxicab passenger vehicle license to protect customer service and to
avoid significant service disruptions under Chapter 53, Section 53-204(f) of the Montgomery County Code.

MCER NO. 10-06:  PROPOSED DEPARTMENT OF PERMITTING SERVICES REGULATION - Schedule of Fees for Permits, Licenses and Certifications - Method 2

SUMMARY:  The proposed regulation, in general, increases by 6.7% permit and license fees that cover the administration, plan-review and enforcement programs of the Department of Permitting Services.  The following  increases for site plan enforcement and Use and Occupancy Certificates are in the County Executive's Recommended FY 07 budget for the Department of Permitting Services.  Implementation of these fees is dependent on County Council approval of related legislation and budget actions.  An additional 28% increase has been added to section one, subsections A - G, "Building Permits with Maryland Capital Park and Planning Commission (MNCPPC) Site Plan Approval" to cover costs associated with additional responsibilities for the plan review and inspection for projects subject to MNCPPC site plan approval. The net effect since July 1, 2005, of the March 1, 2005 surcharge (1.25) with the July 1, 2006 surcharge (1.28) for fees for properties subject to MNCPPC site plans is 60%.  This regulation also adds fees for Use and Occupancy Certificates for additions to and new construction of  detached and attached single family dwellings.  Fees set at $7 or less were increased by $1.  The proposed regulation would supersede Executive Regulation 26-05AM.

MCER NO. 11-06:  PROPOSED DEPARTMENT OF PERMITTING SERVICES REGULATION - Permit Fees and Requirements Related to Construction Debris Reclamation Facility - Method 2

SUMMARY:  The proposed regulation increases permit, license and certificate fees 6.7% as required by Executive Regulation 10-05 Permit Fees and Requirements Related to Construction Debris Reclamation Facility.  The Department of Permitting Services was established as a fee-supported enterprise within the executive branch of Montgomery County in 1996.  Revenues that support the department are established by Method 2 or Method 3 executive regulations and by County Council resolution.  The Department of Permitting Services may raise this fee annually, by regulation, by a percentage that does not exceed the rate of the increase (if any) in the department's approved personnel costs for the then-current fiscal year compared to the approved personnel costs for the preceding fiscal year.  These cost increases reflect negotiated labor agreements, employee-benefit cost adjustments, proficiency advancements, and other personnel cost factors.  Where possible, productivity enhancements will be made to minimize fee increases.  The proposed regulation would supersede Executive Regulation 10-05.

MCER NO. 12-06:  PROPOSED DEPARTMENT OF PERMITTING SERVICES REGULATION - Schedule of Fees for Permits, Licenses and Inspections - Method 3

SUMMARY:  The proposed regulation in general, increases, by 6.7% permit and license fees that cover the administration, plan-review and enforcement programs of the Department of Permitting Services.  New fees added to his regulation are a minimum filing fee for driveway permits and a revision fee for right of way permits.  The proposed regulation would supersede Executive Regulation 9-05.
