MCER NO. 5-09:  PROPOSED DEPARTMENT OF CORRECTION AND REHABILITATION REGULATION - Intervention Program for Substance Abusers Fee

SUMMARY:  The proposed regulation provides a sliding fee schedule for program participants of $50 to $380.  The present fee is $100 - $350.  The proposed regulation would supersede Executive Regulation 81-92.

MCER NO. 6-09:  PROPOSED DEPARTMENT OF ENVIRONMENTAL PROTECTION REGULATION

Residential Waste Estimates for System Benefits Charges

SUMMARY:  Montgomery County Code 2004, Section 48-8A(b) (2) (A), provides that the County Executive must, each fiscal year, establish by Method 2 executive regulation an estimate of the amount of solid waste generated per dwelling unit.  This regulation updates the per-household waste generation estimates used to calculate residential System Benefit Charges.  The proposed regulation would supersede Executive Regulation 15-08.

MCER NO. 7-09:  PROPOSED OFFICE OF HUMAN RESOURCES  REGULATION

Military Family Leave and Other Family and Medical Leave Amendments to the 2001

                          Montgomery County Personnel Regulations

SUMMARY:  The proposed regulation amends Section 19 of the Personnel Regulations to encompass new military family leave entitlements included in amendments to the Family and Medical Leave Act of 1993 (FMLA).  The changes in this regulation also reflect the final rule issued by the U.S. Department of Labor on November 17, 2008, updating and clarifying its FMLA regulations.

Development Impact Tax for Public School Improvements

SUMMARY:  The proposed regulation amends regulation 19-08AM by adding a section, "Tax Rates" that deals with the legal requirement to note the construction cost index used to update the impact tax rates biennially.
