All professional fireworks displays require proper permits from DPS to ensure that they conform to all applicable codes and standards and protect the general safety of the public.

All payments and permit applications, including supporting documentation for review, must be submitted electronically via ePlans.

Can anyone have a fireworks display?

No, only licensed professionals are permitted to display fireworks within Montgomery County. Unlicensed exhibitions are subject to penalties, fees, fines, and other enforcement actions as appropriate.

How it Works

Typically, the State of Maryland Office of the Fire Marshal requires that a permit application be submitted to the State at least 30 days prior to a planned fireworks display. The State application requires the approval of the local fire official, which is DPS Fire Code Compliance. A permit for a fireworks display must be applied for through DPS ePlans. Acceptable methods of payment are credit card, check and e-Check (if submitted electronically). Please visit our eServices page to learn about performing tasks electronically.

Apply and pay for the Fireworks display permit through ePlans. This permit application includes pyrotechnic displays before a proximate audience and flame effects. Be sure to include a site plan with spectator locations and fallout areas clearly labeled. If the fallout area crosses property lines, the effected property owner must provide written approval.

The application materials are reviewed for compliance with the appropriate standard(s). Once the application is approved, the fire inspector will contact the applicant to do a preliminary site inspection to verify that the application materials are accurate with regard to the physical setting. If all requirements are met during the preliminary inspection, the inspector will “sign-off” on the State application for the fireworks display. For fireworks displays not associated with a federal holiday, such as weddings or birthday parties, public notification must be made for the safety of neighboring property, people, and animals at least one week in advance.

How it Works

After all fees are paid and all other requirements are satisfied, the permit technician will issue the DPS fireworks permit. The permit and approved documents will be available to the applicant electronically. Permits may also be picked up at the DPS offices during normal business hours. The shooter may set-up in the days and hours leading up to the display, but no test or practice shots are allowed without the fire inspector on site. Only the licensed shooter(s) listed in the approved application may operate the display.

The day of the event, the fire inspector will be on site for the set-up and loading of the fireworks and the duration of the display until the event has ended. The inspector will return the following morning for a “sunrise walk- through” to verify there are no unexploded fireworks in the fallout area. The shooter, or their designee, must be on site for this post-event inspection to mitigate any found devices.
