Residential Spa and Hot Tub Permits & Inspection Process
A building permit is required for construction, alteration, repair, enlargement, of any permanent or portable spa or hot tub if it is installed within a building or outside a building for permanent installations or when installed on a deck or other structure.
No building permit is required for a portable hot tub or spa installed outside a dwelling.

A building permit is required for construction, alteration, repair, enlargement, of any permanent or portable spa or hot tub if it is installed within a building to ensure that it is adequately supported, stable, listed and labeled and installed in accordance with manufacturer’s specifications. The same requirements apply when the spa or hot tub are installed outside a building for permanent installations or when installed on a deck or other structure.
No building permit is required for a self-contained (plug-in) hot tub or spa installed outside a dwelling.
When the hot tub or spa are installed outside a building, for portable units, the electrical permit application must include the site plan showing the setbacks.
In all circumstances, electrical and mechanical (heating equipment if required), permits are required to complete the project. When the hot tub or spa are installed outside a building, for portable units, the electrical permit application must include the site plan showing the setbacks.
Many of the subdivision and developments in Montgomery County have private deed restrictions and covenants regulating construction. The County does not enforce covenants and deed restrictions. You may obtain information from your homeowner’s or civic association. You may also need a permit or other permission if you live a Montgomery County municipality that requires it.
Applications will be taken in for the intermediate review process and if adequate, permit will be issued within 5 business days.
The manufacturer’s specifications for the hot tub or spa must be included with the permit application.

Homeowners may apply for a Spa and Hot Tub permit in their own name; however, if a contractor is to perform the work, DPS strongly suggests that the contractor be listed on the permit as the party responsible for the work. A contractor must have a Maryland Home Improvement Commission (MHIC) license to obtain a permit.
