MCEO NO. 85-05: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Robert F. Nine and Helen L. Nine, Norbeck Road Extended - CIP Project No. 509321. The option contract between Robert F. Nine and Helen L. Nine and Montgomery County for the purchase of land and granting of an easement for the Norbeck Road Extended project is hereby accepted. The county attorney is directed to take all necessary steps to acquire the land and easement. Effective Date: 3/25/05.
MCEO NO. 86-05: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of a Portion of Kensington Blvd., Wheaton, Maryland. A public hearing was held at 10:30 a.m. on Wednesday, April 6, 2005, at 101 Monroe Street, Rockville, Maryland, in the EOB Lobby Conference Room to consider an application received from Linowes and Blocher on behalf of Anchor Inn Properties, LLC, Grandview Properties, LLC, Old Bladensburg Properties, LLC, and 114316 Georgia Ave. General Partnership, seeking abandonment of a portion of Kensington Blvd. adjoining property owned by the applicants in Wheaton. The Hearing Officer will report his findings and recommendations to the County Executive for further consideration as prescribed by County Code. Effective Date: 3/25/05.

MCEO NO. 107-05: OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition. Whereas the County Executive has determined that acquisition of the Watts Branch Stream Valley Park, Unit 2 is necessary in the public interest, and the determination was made after a public hearing held on March 31, 2005, and was approved for acquisition in the FY 05 Capital Budget, the county attorney is directed to acquire by purchase or condemnation the property owned by David L. Cahoon known as Watts Branch Stream Valley Park, Unit 2, consisting of 8.3 acres. Effective Date: 4/06/05.
MCEO NO. 108-05: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Silent Valley Lane/Dufief Drive Sidewalk (CIP #506747). The County Executive finds that public interest requires construction of a sidewalk in a public right-of-way located in Gaithersburg, Maryland. A public hearing was held on January 20, 2005, after which the hearing examiner recommended approval of the project, and this order authorizes the Director of the Department of Public Works and Transportation to proceed with the construction. A concrete sidewalk, 1100 linear feet long, 4 feet wide, and conforming to the requirements of the ADA, will be built on the north side of Silent Valley Ln. from Happy Choice Ln. to 11605 Silent Valley Ln. and on both sides of Dufief Dr. from Darnestown Rd. to 400' south. Silent Valley Ln. is a secondary residential roadway with a 60' public right-of-way and on-street public parking allowed on both sides. The sidewalk will be constructed with 4 feet of greenspace between the sidewalk and existing edge of roadway. Dufief Dr. is classified as primary residential roadway with a 70' public right-of-way and on-street parking on both sides. The sidewalk will be constructed with no green space between it and the new curb and gutter. The total estimated coast of the project is $50,600.00 which is to be payable from funds appropriated for CIP 506747. Effective Date: 4/13/05.
MCEO NO. 109-05: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - US29/Colesville Rd. Sidewalk (CIP #506747). The County Executive finds that public interest requires construction of a sidewalk in a public right-of-way located in Silver Spring, Maryland. A public hearing was held on January 20, 2005, after which the hearing examiner recommended approval of the project and this order authorizes the Director of the Department of Public Works and Transportation to proceed with the construction. A concrete sidewalk, 615 linear feet long, 5 feet wide and conforming to the requirements of the ADA, will be built at the on the west side of Colesville Road from Saint Andrews Way to 9316 Colesville Road at the back of curb and gutter. Colesville Road is classified as a major roadway approximately 86' wide with a variable width public right-of-way. The total estimated cost of the sidewalk project is $29,700.00 which is to be payable from funds appropriated for CIP 506747. Effective Date: 4/13/05.
MCEO NO. 110-05: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Bayswater Road Sidewalk (#506747). The County Executive finds that public interest requires construction of a sidewalk in a public right-of-way located in Gaithersburg, Maryland. A public hearing was held on January 20, 2005, after which the hearing examiner recommended approval of the project and this order authorizes the Director of the Department of Public Works and Transportation to proceed with the construction. A concrete sidewalk, 2300 linear feet long, 4 feet wide and conforming to the requirements of the ADA, will be built on the north side of Bayswater Road from Horn Point Dr. to Fernshire Rd. Bayswater Road is classified as a secondary residential roadway approximately 26' wide with a 60' public right-of-way and on street parking is allowed on both sides of the street. The sidewalk will be constructed with a variable greenspace of 4 to 11' of greenspace between the sidewalk and curb. The total estimated cost of the sidewalk project is $80,550.00 which is to be payable from funds appropriated for CIP 506747. Effective Date: 4/13/05.
MCEO NO. 111-05: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Hampden Lane Sidewalk (CIP 506747). The County Executive finds that public interest requires construction of a sidewalk in a public right-of-way located in Bethesda, Maryland. A public hearing was held on January 20, 2005, after which the hearing examiner recommended approval of the project and this order authorizes the Director of the Department of Public Works and Transportation to proceed with the construction. A concrete sidewalk, 350 linear feet long, 4 feet wide and conforming to the requirements of the ADA, will be built on the north side of Hampden Ln. from Exeter Rd. to 5211 Hampden Ln. Hampden Ln. is classified as a closed section secondary residential roadway approximately 20' wide with a 50' public right-of-way and on street parking is allowed on the south side of the street. There are approximately 15' of available public right-of-way on the north side of Hampden Ln. and the sidewalk will be constructed with a variable greenspace. The total estimated cost of the sidewalk project is $13.475.00 which is to be payable from funds appropriated for CIP 506747. Effective Date: 4/13/05.
MCEO NO. 112-05: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Fernshire Road Sidewalk (CIP 506747). The County Executive finds that public interest requires construction of a sidewalk in a public right-of-way located in Gaithersburg, Maryland. A public hearing was held on January 20, 2005, after which the hearing examiner recommended approval of the project and this order authorizes the Director of the Department of Public Works and Transportation to proceed with the construction. A concrete sidewalk, 500 linear feet long, 4 feet wide and conforming to the requirements of the ADA, will be built at the on the north side of Fernshire Road from Bayswater Rd. to Longdraft Rd. Fernshire Road is classified as a secondary residential roadway approximately 26' wide with a 60' public right-of-way and on-street parking is allowed on both sides of the street. There are approximately 17' of available public right-of-way on the north side of Fernshire Rd. and the sidewalk will be constructed with a variable greenspace of 4 to 11' of greenspace between the sidewalk and curb. The total estimated cost of the sidewalk project is $19,250.00 which is to be payable from funds appropriated for CIP 506747. Effective Date: 4/13/05.
