MCEO NO. 17-07: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Travilah Road Improvements - CIP No. 500101. The option contract between Gordon V. Smith and Richard J. North, Trustees and Montgomery County, Maryland, for the purchase of land and granting of an easement for the Travilah Road Improvements is hereby accepted. The County Attorney is directed to take all necessary steps to acquire the land and easements. Effective Date: 1/09/07
MCEO NO. 18-07: OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition. The County Executive has determined that acquisition of the Little Bennett Regional Park, owned by Hyattstown Properties, LLC, is necessary in the public interest. This determination was made after a public hearing held on December 7, 2006, and was approved for acquisition in the FY 07 Capital Budget. Effective Date: 1/8/07.
MCEO NO. 19-07: OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition. The County Executive has determined that acquisition of the South Germantown Recreational Park, owned by James M. Colbert, is necessary in the public interest. This determination was made after a public hearing held on January 4, 2007, and was approved for acquisition in the FY 07 Capital Budget. Effective Date: 1/8/07.

MCEO NO. 45-07: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - North Springbrook Neighborhood. This Executive Order transfers the collection districts under procedures established by the County Council in the Comprehensive Solid Waste Management Plan, December 15, 2005, commonly known as the "10-Year Plan" and as amended by Resolution 14-494. On October 6, 2006, 250 homeowners in the North Springbrook Neighborhood petitioned the Department of Public Works and Transportation in writing, requesting to be transferred from Subdistrict B to Subdistrict A, so that they could receive County contracted refuse collection service. This area is adjacent to the boundary of Subdistrict A and B containing at least 200 homes making this eligible for transfer. The petition had legibly signed homeowner signatures from 250 residences in the proposed transfer area which contains 574 homes. DPWT has determined that the requirements of the "10-Year Plan" have been met and has verified that the petition contains 25 percent or more of the residences within the proposed transfer area. Notification was sent to homeowners in the proposed transfer area that households in Subdistrict A are charged an annual collection fee instead of contracting for private trash collection. It also described the current level of service, the annual fee for County provided refuse collection service, the boundaries of the proposed transfer area and the date and location of the public hearing on the transfer. Homeowners were also provided with a ballot that had to be submitted within 60 days after the notice was sent on October 31, 2006. The results of the voting were that 79.96 % of the voters favored the transfer. Since that exceeds 50 % of the number of residences in the area, DPWT recommended that the transfer be approved. Within 30 days of the County Executive's decision, DPWT mailed a notice of the decision to each homeowner in the transfer area. Effective Date: 2/5/07.
MCEO NO. 46-07: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - New Hampshire at Oakview Drive - CIP No. 507017. The option contract between Phuoc Huu Nguyen. and Montgomery County, Maryland, for the granting of an easement for the New Hampshire at Oakview Drive Improvements is hereby accepted. The County Attorney is directed to take all necessary steps to acquire the easement Effective Date: 2/5/07.
MCEO NO.47-07: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Valley Brook Drive Pedestrian Path - CIP No. 508000. A public hearing was held February 27, 2007, in the EOB Lobby Level Auditorium, 101 Monroe St. in Rockville, Maryland, to consider a proposal to provide safe pedestrian travel on Outlot A, Block 1, Springbrook Estates, an abandoned unimproved public right-of-way along Valley Brook Drive from Valley Brook Court to 101 Valley Brook Drive, located in Silver Spring, Maryland. The project provides an asphalt sidewalk and a pedestrian bridge. The sidewalk will be 5' wide and will conform to ADA requirements. The total length of the sidewalk is 540 linear feet. The pedestrian bridge over the stream will be approximately 8' wide and 40' long. Valley Brook Drive has a 60' width public right-of-way. There is approximately 20' of available public right-of-way on this abandoned portion. Estimated cost of the proposed improvement and estimated funding allocations are as follows: Construction costs - $156,000.00; Administrative and construction inspection costs - $62,000.00; total estimated cost of the project, including engineering site improvements and construction - $218,000.00 Effective Date: 2/6/07.
