MCEO NO. 277-07:  FIRE AND RESCUE SERVICE - Employee Solicitation Waiver.  Pursuant to the Montgomery County Public Ethics Law, the County Executive authorizes the Fire Chief to designate employees assigned to Montgomery County Fire and Rescue Service to solicit gifts for the benefit of the Muscular Dystrophy Association (MDA) as part of its "Pass The Boot" campaign, in accordance with the requirements established by this Executive Order. Any employee designated by the Fire Chief may contact potential donors directly.  The purpose of the gifts is to support MDA, a 501(c)(3) tax exempt charitable organization dedicated to conquering neuromuscular diseases that affect more than a million Americans.  The Fire Chief, or the Fire Chief's designee, must authorize all solicitations. A public employee authorized to solicit a gift under this Order may participate in presentations, conduct general solicitations through mailings, participate in media activities, or meet personally with potential donors. An authorized public employee may solicit gifts during official work hours, while identifiable as a public employee, but must not solicit any individual or entity that has a contract with Montgomery County Fire and Rescue Service or any other County agency with which the employee is affiliated. Designated employees may solicit gifts from any individual or entity, including associations, businesses, corporations, foundations, service organizations, chambers of commerce, community groups, religious organizations, and other government agencies.  Gifts may include monetary contributions, goods and services, technical assistance, training space, furniture or equipment cost. Unless the donor makes a written request that there be no public acknowledgement of the gift, the Fire Chief may publicly acknowledge each gift by placing a notice in the Montgomery County Register indicating the gift donated, the identity of the donor, the identity of the recipient of the gift, and the purpose for which the gift will be used. The Fire Chief may issue a press release, if desired. The Fire Chief must notify the Office of the County Executive of the funds collected for the MDA Fill the Boot Campaign. The

Fire Chief may fulfill this requirement by submitting a request for placement of a notice in the Montgomery County Register as outlined above. This Executive Order is issued under the Authority of � 19A-16(b)(3) of the Montgomery County Public Ethics Law and Ethics Commission waiver dated

April 6, 1990.  Effective Date:  8/23/07.

MCEO NO. 281-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Travilah Road Improvements, CIP No. 500101. The option contract between Tova Fliegel and Montgomery County, Maryland, for the purchase of land and granting of easements for the above referenced project is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the land and easements.  Effective Date:  9/4/07.

 

MCEO NO. 282-07:  FIRE AND RESCUE SERVICE - Fire Lane Establishment.  This order is notification of the establishment of a fire lane at Four Irvington Centre, 805 King Farm Blvd.  The department is hereby ordered to post fire lane signs and paint curbs/pavement (painting optional) in the location listed above.  When signs and paint work have been completed, this order will authorize the enforcement of this fire lane by appropriate police and fire officials.  Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign.  The fine for parking in a fire lane is $250.00.  Effective Date:  8/27/07.

 

MCEO NO. 283-07:  DEPARTMENT OF ECONOMIC DEVELOPMENT - Designation of Parcels I the Ripley District of the Silver Spring CBD as a Strategic Economic Development Project.  On July 31, 2007, National Public Radio, notified the County that it is seeking to relocate its headquarters.  The County's investments in Silver Spring, Maryland, have created a thriving telecom and media cluster in the downtown area.  The County seeks to continue this momentum by placing National Public Radio's headquarters in downtown Silver Spring.  The approved Decision Memo dated August 30, 2007, recognizes certain parcels located in the Ripley District of the Silver Spring Central Business District, as matters of significant interest to the County's economic development strategy.  Executive Regulation 31-97, Disposition of Real Property, exempts parking lot district property and property of significant or strategic interest to the County's economic development plan from certain procedures associated with the disposition of real property.  Therefore, parcels listed in Attachment A are to be considered strategic economic development properties as provided in Executive Order Regulation 31 -97, and such parcels or property rights shall be exempted from the disposition procedures of Executive Regulation 31-97; and are authorized, subject to satisfactory negotiations, agreement upon terms, mandatory referral notification, required advertising and due execution of appropriate documentation governing their disposition, to be transferred  to National Public Radio, its designee, or other private parties or entities in conjunction with the relocation of National Public Radio's headquarters to Montgomery County.  Effective Date:  10/4/07.

 

MCEO NO. 284-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Gaithersburg.  REMOVE Speed Limit 25 on Wildcat Road between Davis Mill Rd. and Watkins Rd.  INSTALL Speed Limit 25 on Wildcat Rd. from Davis Mill Rd. to 50' south of Timber Ct. and on Wildcat Rd. from 50' south of Timber Ct. and on Wildcat Rd. from 50' south of Timber Ct. to Watkins Rd.  Effective Date:  9/6/07.

 

MCEO NO. 285-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Woodfield Road Extended - CIP No. 500151.  The option contract between the. Dinah Burdette Mullinix and Montgomery County, Maryland, for the purchase of land and granting of easements for the above-referenced project is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the land and easements.  Effective Date:  9/14/07.

MCEO NO. 286-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Woodfield Road Extended - CIP No. 500151.  The option contract between the Patricia B. Walker and Rispba B. Arnett and Montgomery County, Maryland, for the purchase of land and granting of easements for the above-referenced project is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the land and easements.  Effective Date:  9/14/07.

 

MCEO NO. 287-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  REMOVE No Left Turn for westbound traffic on the northern driveway for the Fairland Center onto Old Columbia Pike and in Silver Spring: for westbound traffic on the southern driveway for the Fairland Center onto Old Columbia Pike.  INSTALL Right Turn Only for westbound traffic on the northern driveway for the Fairland Center onto Old Columbia Pike and in Silver Spring: for westbound traffic on the southern driveway for the Fairland Center onto Old Columbia Pike.  Effective Date:  9/10/07.

MCEO NO. 294-07:  OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition.  The County Executive has determined that acquisition of the Clarksburg Triangle Park, owned by Evelyn Murray and Thomas W. Conley, is necessary in the public interest.  This determination was made after a public hearing held on September 6, 2007, and was approved for acquisition in the FY 08 Capital Budget.  Effective Date:  9/21/07.

 

MCEO NO. 295-07:  OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition.  The County Executive has determined that acquisition of the Clarksburg Triangle Park, owned by the Sol Rudden Revocable Trust, is necessary in the public interest.  This determination was made after a public hearing held on July 5, 2007, and was approved for acquisition in the FY 08 Capital Budget.  Effective Date:  9/25/07.

MCEO NO. 304-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Park Lane Project - CIP No. 500508.  Executive Order No. 195-03 accepted an Option Contract dated December 16,2003 in the amount of $12,720 for the purchase of a permanent easement of 2,653 square feet for Park Lane Project CIP 500508 (the "Project") from the Battery Park Citizens Association, Incorporated.  During the course of constructing the Project, which has been completed, additional costs were incurred by the Battery Park Citizens Association, Incorporated for fencing and security for their property that had not been incorporated into the option contract. The Deed of Perpetual Easement dated October 3, 2007, and signed by Steven A. Teitelbaum, between Battery Park Citizens Association, Incorporated and Montgomery County, Maryland, in exchange for payment in the amount of $19,080.00 incorporates the formerly approved compensation for the Permanent Easement, as well as the increased time value for the property used by the County to construct the project, and the additional value that has accrued to the property from the date of acceptance of the option contract via Executive Order No. 195-03 through April 2007, when the parties resolved title and authority issues that prevented going to settlement earlier.  The deed is hereby approved.  The County Attorney is hereby directed to take all necessary steps to acquire the easement.  Effective Date:  10/29/07.

 

MCEO NO. 305-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Quince Orchard Road, CIP No. 500502.  The option contract between Mei Yu and Wang P. Hsu and Montgomery County, Maryland, for the purchase the granting of easements for the above-referenced project is accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the easements.  Effective Date:  10/1/07.

 

MCEO NO. 307-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Rockville.  INSTALL No Parking Any Time on the north side of Falls Chapel Way from 250' west of Falls Rd. to 475' west of Falls Rd. and on the east side of Cold Springs Rd. from Wandering Trail Dr. to and through the road terminus.  Effective Date:  10/3/07.

 

MCEO NO. 308-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Rockville.  INSTALL Stop for eastbound traffic on Vinyard La. at Cliffbourne La. and: for eastbound traffic on Cliffbourne Ct. at Cliffbourne La.  Effective Date:  10/11/07.

 

MCEO NO. 309-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Travilah Road Improvements - CIP No. 500101.  The option contract between Chuquin Li and Ruizhang Jiang and Montgomery County, Maryland, for the purchase of land and granting of easements for the above-referenced project is accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the land and easements.  Effective Date:  10/16/07.
