MCEO NO. 25-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Jackson Road Bikepath (north side) CIP #506747. Public Hearing. - the County Executive's designee conducted a public hearing at 3:30 p.m. on Wednesday, February 20, 2008, in the first floor auditorium of the Executive Office Building at 101 Monroe Street in Rockville, Maryland. The purpose of this hearing was to consider a proposal to provide safe pedestrian and bicycle travel on the north side of Jackson Rd. from MD650/New Hampshire Ave. and to connect to the existing bikepath at Martin Luther King Recreation Park located in Silver Spring, Maryland. Plans for construction include: an alphalt bikepath on the north side of Jackson Rd. from MD/650 New Hampshire Ave. which will connect to the existing bike path at Martin Luther King Park and be included in the CIP 504747 (Annual Sidewalk Program). The bikepath will be 8 feet wide and will conform to the White Oak Master Plan. The total length of the bikepath is 1,420 linear feet. Jackson Road is classified as a primary residential roadway and has a 70 foot public right-of-way. Jackson Road presently is approximately 36 feet wide with approximately 17 feet of available public right-of-way on the north side. There will be green space of zero to 4' wide located between the bikepath and curb. Project related data and files are available for examination in the offices of the Department of Public Works and Transportation in Rockville, Maryland; 240/777-7270. The estimated total cost is $1,400.00 with construction costs covered by G.O. bonds. Effective Date: 1/31/08.
MCEO NO. 36-08: OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition - Woodstock Esquestrian Park. The County Executive has determined that acquisition of the described property as parkland is necessary in the public interest. Such determination was made after a public hearing held on December 6, 2007, and was approved for acquisition in the FY-08 Capital Budget. The County Attorney is hereby directed to acquire by purchase or condemnation, the property owned by William Lermond, Parcel ID #03-1-02665082, Woodstock Equestrian Park, consisting of 27.01 acres. Effective Date: 2/11/08.
MCEO NO. 37-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Falls Chapel Way Sidewalk (CIP 506747). The County Executive finds that public interest requires the construction of a sidewalk to provide safe pedestrian travel along the west side of Falls Chapel Way from Cold Spring Rd. to Orchard Brook Dr. located in Rockville, Maryland. The director of the Department of Public Works and Transportation is hereby authorized to proceed with the construction of a concrete sidewalk under CIP 506747. The sidewalk will be 4" wide, conform to ADA requirements, and will be 3,200 linear feet long. Falls Chapel Way is classified as a closed section primary residential roadway and has a 70' public right-of-way. The existing roadway is 36' wide with on-street parking allowed on both sides of the roadway. There is a 17' width of available public right-of-way on the northwest side of Falls Chapel Way and the greenspace between the sidewalk and curb will be approximately 10 feet. A public hearing was conducted on the project at 3:00 p.m. on Thursday, June 28, 2007, and continued at 1:00 p.m. on Thursday, July 19, 2007, in the EOB Lobby Auditorium, 101 Monroe St., Rockville, Maryland 20850. The hearing examiner recommended approval of the project. The total estimated cost is $94,000.00 and expenditures authorized by this Executive Order shall not exceed that amount. MCEO NO. 38-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with HSC LLC c/o Karen Mauprivez, Maryland Route 108 Sidewalk, CIP 506747. The option contract for the granting of a permanent sidewalk easement for the above referenced project is accepted. The County Attorney is hereby directed to take all necessary steps to acquire the easements. Effective Date: 2/15/08.
MCEO NO. 44-08: OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition, Capital View Park Open Space. The County Executive has determined that acquisition of the property described in the order is necessary, in the public interest. Such determination was made after a public hearing held on December 20, 2007, and was approved for acquisition in the FY 08 Capital Budget. The County Attorney is hereby directed to acquire by purchase or condemnation the following property: owner, Daniel J. Milton, area of acquisition, 7.22+ acres. Effective Date: 3/10/08.
MCEO NO. 45-08: OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition, Upper Paint Branch Stream Valley Park. The County Executive has determined that acquisition of the property described in the Executive Order is necessary, in the public interest. Such determination was made after a public hearing held on January 31, 2008, and was approved for acquisition in the FY 98 Capital Budget. The County Attorney is hereby directed to acquire by purchase or condemnation, the following described property: owner, Robert Beatty and area of acquisition .46+ acres. Effective Date: 3/10/08.
MCEO NO. 46-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Stabler 1848 LLC, Maryland Route 108 Sidewalk, CIP No. 500703. The option contract for the granting of a permanent sidewalk easement for the above mentioned project is accepted. The County Attorney is directed to take all necessary steps to acquire the easements. Effective Date: 3/11/08.
MCEO NO. 70-08: DEPARTMENT OF TECHNOLOGY SERVICES - Set Cable Television Rates Pursuant to FCC Form 1205. The Executive Order, Order of the County Executive Setting Cable Television Rates for Equipment and Installations Pursuant to FCC Form 1205 Filed April 2, 2007, sets cable television rates giving details on the background of the negotiations. Also covered are the findings and conclusions on the inside wire maintenance plan, installation times, and data from effective competition systems. Section 3 of the order lists the 40 ordering clauses. Effective Date: 3/31/08.
MCEO NO. 71-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Chang Ho Kay Trust and Chunghwa T. Kay Trust, Silver Spring Library, CIP No. 710302. The option contract listed above for the purchase of land and improvements is accepted. The contract has been obtained and the County Attorney is directed to take all necessary steps to acquire the land. Effective Date: 3/27/08.
MCEO NO. 72-08: DEPARTMENT OF PERMITTING SERVICES - Street Acceptance. This order certifies that construction of the following named streets has been completed in accordance with all applicable provisions of the Montgomery County Road Construction Code as specified in the above listed permit. The materials used in the construction of these streets were tested and found to be in compliance with County specifications: Honesty Drive (Foggy's Pasture), Hidden Ponds Way, Hidden Ponds Court, Carrington Hill Drive (Willow Ridge), Basswood Hill Drive, Birch Mead Road, Chestnut Glen Road, Cypress Spring Road, Press Spring Road, intersections of Sycamore Farm Drive and Chestnut Glen Road, Sycamore Farm Drive, Winged Elm Drive, (Greenway Village), Auburn Village Drive (Auburn Village at Sandy Spring). The roads listed are hereby accepted for maintenance. Effective Date: 3/25/08.

This order certifies that construction of the following named streets has been completed in accordance with all applicable provisions of the Montgomery County Road Construction Code as specified in the above listed permit. The materials used in the construction of these streets were tested and found to be in compliance with County specifications: Cider Barrel Drive, Oxbridge Drive, Cider Press Place (Mary J. Boland), Fable Drive (Hoyles Mill Village), Finegan Farm Drive (Finegan Farm), Patriot Lane (Potomac Crest). Above listed roads are hereby accepted for maintenance. Effective Date: 3/27/08.
MCEO NO. 74-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Huda Durant, Faisal Khan and Murtaza Khan, Silver Spring Library, CIP 710302. The option contract for the purchase of land and improvements for the above-reference project is accepted. The County Attorney is directed to take all necessary steps to acquire the land and improvements. Effective Date: 3/31/08.
MCEO NO. 83-08: MONTGOMERY COUNTY FIRE AND RESCUE SERVICE - Fire Lane Establishment. This order establishes a fire lane at Moores Addition to Wedgewood, Lots 23-24, Block 3, a resubdivision of Lot 9 Block 3, 6209 Wedgewood Rd. It is ordered to post fire lane signs and paint curbs/pavement (painting optional) in this location. When signs and paint work have been completed, this order will authorize the enforcement of this fire lane by appropriate police and fire officials. Compliance with this order must be achieved within 30 days of receipt. Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign and signs must be no further apart than 100 feet. The fine for parking in a fire lane is $250. Effective Date: 4/09/2008.
MCEO NO. 92-08: OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition, Black Hill Regional Park. The County Executive has determined that acquisition of the property owned by Robert M. and Grace A. Beacham, Black Hill Regional Park, is necessary in the public interest. The determination was made after a public hearing held on April 3, 2008, and was approved for acquisition in the FY 08 and FY 09 Capital Budget. Therefore the County Attorney is directed to acquire by purchase or condemnation this listed property. Effective Date: 4/16/08.
MCEO NO. 93-08: MONTGOMERY COUNTY FIRE AND RESCUE SERVICE - Fire Lane Establishment. This order establishes a fire lane at Won Buddhism of the USA Inc., 4253 Muncaster Mill Road. It is ordered to post fire lane signs and paint curbs/pavement (painting optional) in this location. When signs and paint work have been completed, this order will authorize the enforcement of this fire lane by appropriate police and fire officials. Compliance with this order must be achieved within 30 days of receipt. Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign and signs must be no further apart than 100 feet. The fine for parking in a fire lane is $250. MCEO NO. 94-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Public Hearing - Abandonment of Lybrook Drive, Lee Lloyd's Addition to Burning Tree Valley Subdivision, Bethesda. A public hearing will be conducted by a designee of the County Executive at 2:15 p.m. on Monday, June 9, 2008, in the EOB Lobby Conference Room, Executive Office Building, Rockville, Maryland 20850 to consider an application received from Miles & Stockbridge, on behalf of its client, AssetOne Construction LLC, the applicant, seeking abandonment of unimproved Lybrook Drive in Lee Lloyd's Addition to Burning Tree Valley Subdivision in Bethesda. After the hearing, the hearing officer will report his or her findings and recommendations to the County Executive for further consideration as prescribed by the County Code. Effective Date: 4/17/08.
MCEO NO. 95-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Dennis Avenue Sidewalk (CIP 506747). A public hearing was held before the hearing officer designated by the County Executive on Tuesday, May 20, 2008, in the first floor auditorium of the EOB at 101 Monroe Street in Rockville, Maryland. The purpose of the hearing was to consider a. proposal to provide safer pedestrian travel by constructing a concrete sidewalk along the south side of Dennis Ave. under Capital Improvement Project 506747 (Annual Sidewalk Program). The construction site is in Silver Spring, Maryland. Dennis Ave. is classified as a primary residential roadway and is approximately 33' wide and has 60' of existing public right-of-way. The sidewalk along Dennis Ave. between Jaywood Dr. and MD97/Georgia Ave. will be five feet wide and the total length of the proposed sidewalk is approximately 2,040 linear feet. There will be a variable greenspace located between the sidewalk and edge of pavement. The new sidewalk will conform to the ADA requirements and the total estimated cost of the project is $106,130.00. Effective Date: 4/23/08.
MCEO NO. 96-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Gold Mine Road Bikepath (CIP 507596). A public hearing was held before the designee of the County Executive at 4:00 pm on Tuesday, May 20, 2008, in the first floor auditorium of the Executive Office Building at 101 Monroe Street in Rockville, Maryland. The purpose of this hearing was to consider a proposal to provide safer pedestrian and bicycle travel by constructing an asphalt bikepath along the south side of Gold Mine Road under Capital Improvement Project 507596 (Annual Bikeway Program). The proposed bikepath construction site is located in Brookeville, Maryland. Gold Mine Road is classified as a primary residential roadway and is approximately 27' feet of existing public right-of-way. The bikepath along Gold Mine Road between James Creek Court to the existing sidewalk located at 2400 Gold Mine Road will be eight feet wide and the total length of the proposed bikepath is approximately 4,880 linear feet. There will be a variable greenspace of zero to four feet located between the bikepath and edge of pavement. The total estimated cost of the project is $270,606.00. Effective Date: 4/23/08.
MCEO NO. 106-08: MONTGOMERY COUNTY FIRE AND RESCUE SERVICE - Fire Lane Establishment. This order establishes a fire lane at Homecrest, 3802-3808 Big Bear Terrace. It is ordered to post fire lane signs and paint curbs/pavement (painting optional) in this location. When signs and paint work have been completed, this order will authorize the enforcement of this fire lane by appropriate police and fire officials. Compliance with this order must be achieved within 30 days of receipt. Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign and signs must be no further apart than 100 feet. The fine for parking in a fire lane is $250. Effective Date: 5/02/08.

It is ordered to post fire lane signs and paint curbs/pavement (painting optional) in this location. When signs and paint work have been completed, this order will authorize the enforcement of this fire lane by appropriate police and fire officials. Compliance with this order must be achieved within 30 days of receipt. Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign and signs must be no further apart than 100 feet. The fine for parking in a fire lane is $250. Effective Date: 5/02/08.
MCEO NO. 117-08: COMMISSION FOR WOMEN - Authorization for Assessment of User Fees for Programs, Services or Activities Provided by the Commission for Women. The County Executive may (Section 27-33A of the Montgomery County Code, 2004) by executive order, impose user fees on participants in the programs, services, or activities conducted by the Commission for Women. Effective July 1, 2008, the fees charged for the programs, services, or activities conducted by the CFW are as follows: Groups, workshops, seminars - $20 per session, Counseling - $50 per session, Professional Training - $55 per session, Vocational and personality type testing $48 per test. The Commission for Women may set other reasonable fees for occasional programs, services, or activities, as it deems appropriate. A full or partial waiver may be granted to county residents in accordance with a sliding fee payment scale implemented by the Commission for Women in order to accommodate participants who cannot afford to pay any part or all of the fee amount. Non-county residents are not eligible to receive any fee waivers. Effective Date: 7/01/08.
MCEO NO. 121-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Public Hearing - Abandonment of Portion of Walkers Mill Road, Gaithersburg. A public hearing will be conducted by a designee of the County Executive at 2:00 p.m. on Monday, June 9, 2008, in the EOB Lobby Conference Room, Executive Office Building, Rockville, Maryland 20850 to consider an application received from D'Amore Construction Company Inc., on behalf of its clients Mr. and Mrs. H. Winfree Irvine, Jr., the applicants, seeking abandonment of a portion of Walkers Mill Road situated entirely within the boundaries of property owned by the applicants in Gaithersburg. After the hearing, the hearing officer will report his or her findings and recommendations to the County Executive fur further consideration as prescribed by the County Code. Effective Date: 5/08/08.
MCEO NO. 122-08: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Surplus and Sale of County-owned Property Decision Memorandum, Catherine M. Wagener. Montgomery County is the owner of Outlot A on Tax Map JP22, Property Identification No. 13-95-1338080. The parcel consists of 1,897 square feet and is zoned R60. The County acquired the property in 1971 due to unpaid property taxes. The property was previously owned by William S. (now deceased) and Catherine M. Wagener. The Department of Public Works and Transportation recommends to the Assistant Chief Administrative Office that the subject property be declared surplus and available for sale to Mrs. Catherine M. Wagener for $1,327.90. It is determined that the subject property is a splinter parcel that is surplus to the needs of Montgomery County, thus DPWT is authorized to convey the subject property to Mrs. Catherine M. Wagener in a Quitclaim Deed for the sum of $1,327.90. Effective Date: 5/13/08.
