MCEO NO. 316-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - White Ground Bridge - CIP No. 500505.  A public hearing was held before the hearing examiner at 3:00 PM on Tuesday, December 4, 2007, in the Lobby Auditorium of the Executive Office Building at 101 Monroe St. in Rockville, Maryland, to consider a proposal to replace the White Ground Road Bridge No. M-0138 over Buck Lodge Branch, a public highway bridge located in Boyds, Maryland.  The project will include replacing the White Ground Road Bridge No. M-0138 over Buck Lodge Branch, a public highway bridge located in Boyds, Maryland.  Estimated cost of the proposed improvement and funding allocations are as follows:  Montgomery County - $1,371,000.00; total estimated cost of project - $1,371,000.00.  Effective Date:  10/26/07.

 

MCEO NO. 325-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Falls Road and River Road Sidewalk - CIP No. 506747.  The option contract between Chevy Chase Bank F.S.B. and Montgomery County, Maryland, for the granting of easements for the above referenced project is accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the easements.  Effective Date:  11/1/07.

 

MCEO NO. 326-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Redland Road from Crabbs Branch Way to Needwood Road - CIP No. 500010.  The option contract between Redland Place Homeowners Association, Inc., and Montgomery County, Maryland, for the purchase of land and granting of an easement for the above referenced project is accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the land and easement.  Effective Date:  11/1/07.

MCEO NO. 331-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of Portion of Marden Lane, Brooke Grove, Sandy Spring, Maryland.  A public hearing was held before the hearing examiner at 1:30 PM on Monday, January 7, 2008, in the Lobby Conference Room of the Executive Office Building at 101 Monroe St. in Rockville, Maryland, to consider an application received from Miller, Miller & Canby, on behalf of its client, Brooke Grove Foundation, Inc., the applicant, seeking the modification of Condition No. 5 of a previously approved abandonment of Marden Lane, Council Resolution No. 13-914. The Condition required the applicant to install an electronic gate at the end of Marden Lane for the benefit of two property owners. The gate is now within the Brooke Grove campus in Sandy Spring, and all surrounding property is owned by the applicant.  The hearing examiner will present his findings and recommendations to the County Executive for further consideration as prescribed by the County Code.  Effective Date:  11/1/07.

MCEO NO. 336-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of a Portion of Willington Drive, F.R. Gordon's Addition to Rocky Brook Park Subdivision, Sandy Spring, Maryland.  A public hearing was held before the hearing examiner at 1:00PM on Monday, January 7, 2008, in the Lobby Conference Room of the Executive Office Building at 101 Monroe St. in Rockville, Maryland, to consider an application received from Mr. Carey E. Hoobler, the applicant, seeking abandonment of a portion of unimproved Willington Drive, F.R. Gordon's Addition to Rocky Brook Park Subdivision, in Silver Spring.  The hearing examiner will present his findings and recommendations to the County Executive for further consideration as prescribed by the County Code.  Effective Date:  11/5/07.

MCEO NO. 337-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Montrose Parkway West, CIP No. 500311 - Condemnation Authorization.  By advance taking, Montgomery County has acquired property owned by M. E. Armstrong that is considered necessary to the construction of the Montrose Parkway West project.  The two parties have not been able to agree on an amount to be paid for the property, therefore Montgomery County may institute condemnation proceedings under Section 49-46 of the Montgomery County Code.  The County Attorney is directed to acquire by condemnation this property, Liber/Folio- WES 102/47, owned by M.E. Strong.  Effective Date:  11/5/07.

 

MCEO NO. 338-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  INSTALL Permit Parking 9 AM - 5 PM Monday - Friday Forest Grove on the south side of Belvedere Blvd. from Woodland Dr. to the eastern property line of 1800 Belvedere Blvd.  Effective Date:  11/7/07.

 

MCEO NO. 339-07:  FIRE AND RESCUE SERVICE - Fire Lane Establishment.  This order is notification of the establishment of a fire lane at Fraley's Green, Muncaster Mill Rd.  The department is hereby ordered to post fire lane signs and paint curbs/pavement (painting optional) in the location listed above.  When signs and paint work have been completed, this order will authorize the enforcement of this fire lane by appropriate police and fire officials.  Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign.  The fine for parking in a fire land is $250.00.  Effective Date:  11/8/07.

MCEO NO. 343-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Sherwood Forest Manor/Drumeldra Hills.  This Executive Order transfers the collection districts under procedures established by the County Council in the Comprehensive Solid Waste Management Plan, November 15, 2005, commonly known as the "10-Year Plan" and as amended by Resolution 14-494.  On June 12, 2007, a grou of 207 homeowners in the Sherwood Forest Manor and Drumeldra Hills neighborhoods petitioned the Department of Public Works and Transportation in writing, requesting to be transferred from Subdistrict B to Subdistrict A, so that they could receive County contracted refuse collection service.  This area is adjacent to the boundary of Subdistrict A and B containing at least 200 homes making this eligible for transfer.  The petition had legibly signed homeowner signatures from 207 residences in the proposed transfer area which contains 446 homes.  DPWT has determined that the requirements of the "10-Year Plan" have been met and has verified that the petition contains 25 percent or more of the residences within the proposed transfer area.  Notification was sent to homeowners in the proposed transfer area that households in Subdistrict A are charged an annual collection fee instead of contracting for private trash collection.  It also described the current level of service, the annual fee for County provided refuse collection service, the boundaries of the proposed transfer area and the date and location of the public hearing on the transfer.  Homeowners were also provided with a ballot that had to be submitted within 60 days after the notice was sent on August 31, 2007.  The results of the voting were that 75.34 % of the voters favored the transfer.  Since that exceeds 50 % of the number of residences in the area, DPWT recommended that the transfer be approved.  Within 30 days of the County Executive's decision, DPWT mailed a notice of the decision to each homeowner in the transfer area.  Effective Date:  12/4//07.

 

MCEO NO. 344-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Greencastle Road Improvement - CIP No. 500100.  The option contract between the Greencastle Woods community Association, Inc., and Montgomery County, Maryland, for the granting of an easement for the above referenced project is accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the easement.   Effective Date:  11/26/07.

 

MCEO NO. 345-07:  DEPARTMENT OF PERMITTING SERVICES - Adoption of the 2006 IBC, IRC, IECC, IMC, IFCG.  A public hearing was held at 2:00 PM on Thursday, January 10, 2008 at 255 Rockville Pike, 2nd Floor, Seneca Conference Room, Rockville, Maryland, to consider a proposed regulation for the adoption of the 2006 Building Codes.  The hearing examiner will present his findings and recommendations to the County Executive for further consideration as prescribed by the County Code.  Effective Date:  11/19/07.

 

MCEO NO. 346-07:  DEPARTMENT OF FINANCE - Approving the issuance of Virginia Resources Authority Tax-Exempt Revenue Bonds.  The City of Falls Church, Virginia, has advised Montgomery County, Maryland (the "County") that the City has requested that the Virginia Resources Authority issue one or more series of its tax-exempt revenue bonds in an aggregate principal amount not to exceed $9,000,000.  Pursuant to its plan of finance for the hereinafter-described Residuals Management Project, the City has requested VRA to issue the VRA Bonds and lend the proceeds thereof to Falls Church.  Falls Church will use the proceeds it receives from VRA to pay the City's share of the cost of the acquisition and construction of facilities, and the acquisition and installation of equipment, to collect and dewater solids or residuals resulting from the water treatment process at the Washington Aqueduct.  The Residuals Management Project is being undertaken by the United States of America, acting through the Secretary of the Army, the Department of the Army and/or the U.S. Army Corps of Engineers, and the financed property will initially be owned, operated and managed by the Corps.  The Residuals Management Project will be undertaken at (i) the Dalecarlia Water Treatment Plant, 5900 MacArthur Boulevard N.W., Washington D.C., (ii) the Dalecarlia Reservoir, located along MacArthur Boulevard within one mile northeast of the WTP in Washington, DC, and Montgomery County, Maryland, (iii) the Georgetown Reservoir, 4700 MacArthur Boulevard N.W., Washington, D.C., and (iv) the Dalecarlia Forebay site, adjacent to the Dalecarlia Reservoir in Montgomery County, Maryland.  The Corps's address is 5900 MacArthur Boulevard N.W., Washington, D.C. 20315=0220, Chief, Washington Aqueduct, U.S. Army Corps of Engineers.  The Washington Aqueduct provides a portion of the water supply for the residents of the District of Columbia, Falls Church, and Arlington County, Virginia.  No more than $9,000,000 of the proceeds of the VRA Bonds will be used to finance facilities located in the County pursuant to Section 147(f) of the Internal Revenue Code of 1986, as amended, in order for the interest payable on the VRA Bonds to qualify for exclusion from gross income for federal income tax purposes, among other requirements, prior to their issuance, the VRA Bonds are required to be approved by the "applicable elected representative" of the governmental unit having jurisdiction over the entire area of a state in which any facility financed or refinanced by the VRA Bonds is located, after a public hearing held following reasonable public notice.  The facilities located at the Dalecarlia Forebay site and the Maryland portion of the Dalecarlia Reservoir are located within the territorial limits of the County such that approval of the County Projects and of the VRA Bonds by an applicable elected representative of the County is required as described above.  The County Executive of the County is an applicable elected representative of the County.  A public hearing was conducted on behalf of the County by the City Council of a daily newspaper of general circulation in the County.  Falls Church has delivered to the County a transcript of the public hearing.  It is intended that this Order shall constitute the approval of the VRA Bonds, the Plan of Finance and the County Projects required by Section 147(f) of the Code.  In satisfaction of the requirements of Section 147(f) of the Code, the County hereby approves the VRA Bonds, the Plan of Finance and the County Projects.  It is the purpose and intent of the County Executive that this Executive Order constitutes approval of the VRA Bonds, the Plan of Finance and of the County Projects for the purposes of Section 147(f) of the Code.  The County does not bear any responsibility for the tax-exempt status of the VRA Bonds, the debt service on the VRA Bonds or any other matter related to the VRA Bonds, the creation or implementation of the Plan of Finance or the construction or operation of the County Projects.  The County has accepted as true and accurate the actions of Falls Church as evidenced by the Notice and the Hearing Report.  The City shall pay directly or cause to be paid all costs, fees and expenses incurred by or on behalf of the County in connection with the issuance, sale, delivery and administration of the VRA Bonds including costs of printing and issuing the VRA Bonds, legal expenses, and compensation to any person performing services by or on behalf of the County in connection therewith, to the extent that such costs are not paid from the proceeds of the VRA Bonds.  The County Administrative Officer, the Director of Finance, and such other officers, officials and employees of the County as the County Administrative Officer or the Director of Finance shall designate, are authorized hereby to do any and all things, execute all instruments, documents and certificates, and otherwise take all action necessary, proper, or expedient in connection with this approval of the VRA Bonds, the Plan of Finance and the County Projects for purposes of satisfying the requirements of Section 147(f) of the Code.  Effective Date:  11/27/07.
