MCER NO.   1-04AM: FIRE AND RESCUE SERVICE REGULATION -

Enforcement Procedure for the Fire Administrator Regarding Local Fire and

                                 Rescue Department Personnel

SUMMARY: This regulation is being requested for repeal because it has been obsolete since Bill 36-03 reorganized the Montgomery County Fire and Rescue Service.  Montgomery County Code Section 21-3.(g) now authorizes the Fire Chief to take disciplinary action against any MCFRS employee or volunteer, including those in a local fire and rescue department, for violating any County law, regulation, policy, or procedure, or any lawful order of the Fire Chief or the Chief's designee.  However, the Chief must not take any action involving an employee or volunteer of a local fire department, except when immediate action is required to protect the safety of the public or any employee or volunteer, unless the Chief finds that the local department has not satisfactorily resolved the problem in a timely and effective manner.
