MCER NO. 15-07:  PROPOSED DEPARTMENT OF PERMITTING SERVICES REGULATION

Permit Fees and Requirements Related to Construction Debris Reclamation Facility

SUMMARY:  The proposed regulation increases permit, license and certificate fees by 6.7% as required by Executive Regulation 10-05 Permit Fees and Requirements Related to Construction Debris Reclamation Facility.  The Department of Permitting Services was established as a fee-supported enterprise within the Executive Branch of Montgomery County in 1996.  Revenues that support the Department are established by Method 2 or Method 3 Executive Regulations and by County Council resolution.  The Department of Permitting Services may raise this fee annually by regulation by a percentage that does not exceed the rate of the increase (if any) in the department's approved personnel costs for the then-current fiscal year compared to the approved personnel costs for the preceding fiscal year.  These cost increases reflect negotiated labor agreements, employee-benefit cost adjustments, proficiency advancements, and other personnel cost factors.  Where possible, productivity enhancements will be made to minimize fee increases.  The proposed regulation would supersede Executive Regulation 10-05.

MCER NO. 16-07:  PROPOSED DEPARTMENT OF PERMITTING SERVICES REGULATION

                            Schedule of Fees for Permits, Licenses and Inspections - Method 3

SUMMARY:  The proposed regulation, in general, increases by 6.7% permit and license fees that cover the administration, plan review and enforcement programs of the Department of Permitting Services.  Fees were corrected in sections (I.F., I.H., II.A.9., VI.A.2., VI.A.4.) where fees were not updated in the previous Executive Regulation 3-07.  Language was added to Section II.A.7. for clarification.  Section I.J. was added to include fees for replacement and reduction of right-of-way bonds, which is consistent with language in II.A.9. for sediment control bonds.  Section I.K was added to include a fee for change of legal description or other administrative revisions to a right-of-way permit.

MCER NO. 17-07:  PROPOSED DEPARTMENT OF PERMITTING SERVICES REGULATION

                            Schedule of Fees for Permits, Licenses and Certifications - Method 2

SUMMARY:  The proposed regulation, in general, increases, by 6.7% permit and license fees that cover the administration, plan review and enforcement programs of the Department of Permitting Services.  Section I.B.4. & 5. and II.B.4. & 5. were changed to identify separate fees for additions and alterations.  The prior Executive Regulation 30-06 should have changed the fees for additions but not alterations due to the implementation of the drainage ordinance.  This change corrects that fee.  The proposed regulation would supersede Executive Regulation 30-06.

MCER NO. 18-07:  PROPOSED OFFICE OF HUMAN RESOURCES REGULATION

MCPR Amendment on Active Fire and Rescue Volunteers Applying for "Employees

                            Only" Vacancies

SUMMARY:  The proposed regulation amends MCPR Section 6-2 to provide that the OHR Director must allow active fire and rescue volunteers to apply for vacancy announcements that are limited to County employees only.
