MCER NO. 23-09:  ADOPTED OFFICE OF HUMAN RESOURCES REGULATION

Probationary Period for Noncompetitive Reappointments

SUMMARY:  This regulation amends Section 7 of the 2001 Montgomery County Personnel Regulations to clarify under what circumstances an employee who receives a noncompetitive appointment must serve a probationary period.  The adopted regulation supersedes Executive Regulation 12-00AM II, in part.

ACTION:  Executive Regulation 23-09 was approved by the County Council according to the Method 1 process, effective March 9, 2010.

MCER NO. 24-09AM:  ADOPTED OFFICE OF THE CHIEF ADMINISTRATIVE OFFICER REGULATION

Financial Disclosure

SUMMARY:  This regulation designates those public employees that the County Executive requires to file a public, limited public, or confidential financial disclosure statement.  This amendment constitutes the annual revision of this regulation, and establishes a process for identifying specific employees who must file a financial disclosure statement.  The adopted regulation supersedes Executive Regulation 35-08.

ACTION:  Executive Regulation 24-09AM was approved by the County Council according to the Method 2 process, effective March 9, 2010.

MCER NO. 28-09:  ADOPTED OFFICE OF HUMAN RESOURCES REGULATION

Gain Sharing Program and Performance-Based Pay for MLS Employees

SUMMARY:  This regulation amends Section 10 of the 2001 Montgomery County Personnel Regulations to provide that any decision by the review panel or the Chief Administrative Officer relating to the Rewarding Excellence Bonus Incentive Awards Program ("Gain Sharing Program") cannot be grieved or appealed.  The regulation also clarifies that an MLS employee with merit system status who receives a performance rating of "Below Expectations" is not eligible for performance-based pay but receives the general wage adjustment awarded to other unrepresented employees.  In addition, the regulation makes clear that an employee on the general salary schedule who receives a performance rating of "Below Expectations" is not eligible to receive a performance-based pay award.  The adopted regulation supersedes Executive Regulation 23 07AM II, in part.
