MCER NO. 27-09:  PROPOSED OFFICE OF HUMAN RESOURCES REGULATION

General Applicability of Personnel Regulations to Employees of Local Fire and

                            Rescue Departments

SUMMARY:  The proposed regulation, amending Section 2-2(m) of the Montgomery County Personnel Regulations to clarify, in accordance with a recent decision by the Merit System Protection Board, that the Personnel Regulations are generally applicable to employees of Local Fire and Rescue Departments, was advertised in the December 2009 Montgomery County Register.  At the Board's request, the regulation now also modifies Section 35-8 of the Personnel Regulations to indicate that should an LFRD employee file an appeal with the Board; the Board will notify the head of the LFRD, and that it is the LFRD, rather than the County Attorney or the Office of Human Resources Director, who must provide a response to the appeal.  At the request of the County Attorney's Office, the regulation now also clarifies who must respond to an appeal filed by a volunteer firefighter or rescuer with the Board.   In light of these additions the regulation is being re-advertised.  The proposed regulation would supersede Executive Regulation 12-00AM II, in part and 14-09, in part.
