MCER NO. 4-05AM:   REPEAL OF FIRE AND RESCUE COMMISSION REGULATION

Procedures for FRC Appeal Hearings

SUMMARY:  The Procedures for Fire and Rescue Commission Appeal Hearings governed hearings of Fire & Rescue Commission appeals, in accordance with Sec. 21-7(c) of the Montgomery County Code, 1994, as amended.  The Procedures adopted the language of the Administrative Procedures Act to specifically correspond to procedures for FRC appeals.  The Regulation is being repealed because Bill #38-08, adopted on August 1, 2009, abolished the Fire and Rescue Commission (FRC), and created the Fire and Emergency Services Commission (FESC).  The FESC has no statutory authority for hearing appeals.  This responsibility now rests with the Merit Systems Protection Board, under procedures established by the County Executive.  Executive Regulation 4-05AM was repealed on February 2, 2010.
