MCER NO. 5-12:  PROPOSED DEPARTMENT OF ENVIRONMENTAL PROTECTION REGULATION
                           Systems Benefit Charges-Residential Waste Estimates

SUMMARY:  Montgomery County Code 2004, Section 48-8A(b)(2)(A), provides that the County Executive must, each fiscal year, establish by Method 2 executive regulation an estimate of the amount of solid waste generated per dwelling unit.  This proposed regulation updates the per-household waste generation estimates used to calculate residential Systems Benefit Charges.  The proposed regulation would supersede Executive Regulation 4-11.

MCER NO. 6-12:  PROPOSED DEPARTMENT OF ENVIRONMENTAL PROTECTION REGULATION
                           Licensing and Permitting Fees for Solid Waste Collectors and Haulers

SUMMARY:  This proposed regulation establishes the permit and license fees for solid waste collectors and haulers.  The annual licensing fee for a company whose principal business is the collection or hauling of solid waste is $25.00, and the permitting fee for each commercial vehicle is $5.00.

MCER NO. 8-12:  PROPOSED DEPARTMENT OF PERMITTING SERVICES REGULATION
                           Adoption of the 2012 IBC, IRC, IECC, IMC, and IFGC

SUMMARY:  This proposed regulation would adopt the International Code Council's (ICC) 2012 International Building, Energy Conservation, Mechanical, Fuel-Gas, and Residential Codes with amendments.  It governs all buildings and structures within Montgomery County.  This regulation remedies some significant consequences from the previous regulation.  The proposed regulation would supersede Executive Regulation 14-10.

MCER NO. 9-12:  PROPOSED DEPARTMENT OF PERMITTING SERVICES REGULATION
                           Fire Safety Code - Fire Protection Systems

SUMMARY:  This proposed regulation would adopt and modify certain standards published by the National Fire Protection Association (NFPA) involved with the installation, testing and maintenance of certain fire protection systems as required by the Montgomery County Building Code, the Montgomery County Fire Safety Code and the Maryland State Fire Prevention Code.  The Department of Permitting Services has been delegated the authority by the Fire Chief of Montgomery County Fire and Rescue Services to adopt regulations pursuant to Chapter 22 of the Montgomery County Code in the cases of a new building, a new system, or new conditions.

MCER NO. 10-12:  PROPOSED DEPARTMENT OF PERMITTING SERVICES REGULATION
                             Fire Safety Code - Building Construction

SUMMARY:  This proposed regulation would adopt the applicable editions of various National Fire Protection Association (NFPA) standards - most notably NFPA 1, Uniform Fire Code and NFPA 101, Life Safety Code - as adopted by the Maryland State Fire Prevention Code.  These codes and the associated codes and standards incorporated by reference are adopted to set the minimum requirements to establish a reasonable level of safety from the hazards created by fire, explosion, and dangerous conditions.  The changes do not retroactively apply to unaltered existing buildings, existing systems or existing conditions permitted or approved before the date of adoption of this regulation unless an inimical hazard exists.

MCER NO. 11-12:  PROPOSED DEPARTMENT OF PERMITTING SERVICES REGULATION
                             Schedule of Fees for Permits, Licenses and Certifications-Method 2

SUMMARY:  This proposed regulation adds Fire Code inspection and related fees to the Department of Permitting Services (DPS) fee schedule.  These permit fees were previously a part of the Montgomery County Fire and Rescue Service's (MCFRS) Executive Regulation 5-06AM, Fire Safety Code - Fee Schedule for Inspections, Permits, Licenses, Certificates and Exceptions.  By agreement with MCFRS the DPS assumed responsibility for fire permit inspections on February 1, 2012.  The fee amounts have not been increased.  Fire inspection fees are now included in: Section V, Fire Code Building Permit Inspection Fees; Section VI, Certificate Fees, Section VII, License Fee - Fire Protection/Detection System and Section X.H.3, Building permit construction code modification requests for fire codes.  This regulation has also been revised to clarify existing fee descriptions.  The proposed regulation would supersede Executive Regulation 5-11AMIII.

MCER NO. 12-12:  PROPOSED DEPARTMENT OF FIRE AND RESCUE SERVICES REGULATION
                             Fire Safety Code Inspections, Permits, Licenses, Exceptions, and Fees

SUMMARY:  This proposed regulation reflects the assignment of all new construction permitted work to the Department of Permitting Services, revises inspection and documentation requirements to focus on maintenance of fire protection systems and features, identifies when payment is due, defines total inspection time, amends the fee-exempt status of other government units and facilities, reduces and simplifies the penalty accrual amount for late or non-payment, identifies the responsibility for fire protection systems and features maintenance and testing, clarifies when certain permits will be issued amends the requirements for corporate and employee fire protection contractor licensing, reduces the fees and extends the term for fire protection contractor licensing, and retitles the surcharge on all fees collected and specifies how they are to be expended.  The proposed regulation would supersede Executive Regulation 5-06AM.
