MCER NO. 9-90:   PROPOSED REPEAL OF DEPARTMENT OF FIRE AND RESCUE SERVICE REGULATION
Pager Criteria Policy

SUMMARY:  Executive Regulation 9-90 is proposed for repeal because its provisions are outdated and no longer conform with current procedures.  The Regulation established a policy to ensure the application of fair and consistent criteria for issuing pagers to personnel of the Fire and  Rescue Services in Montgomery County.  The policy provides procedures for requesting alerting pagers, tracking issued pagers, and accomplishing the replacement and repair of pagers.  A new policy is being developed that will replace repealed Regulation #9-90 with MCFRS’ current practices and procedures.

MCER NO. 29-90:  PROPOSED REPEAL OF DEPARTMENT OF FIRE AND RESCUE SERVICE REGULATION
                          Workers’ Compensation Claims

SUMMARY:  Executive Regulation 29-90 is proposed for repeal because its procedures are outdated and no longer conform with current practices.  The Regulation established a standard method for reporting and filing claims for on-duty injuries and occupational diseases sustained by Montgomery County Fire and Rescue Service career and volunteer personnel.  A new policy is being developed that will replace repealed Regulation #29-90 with current practices and procedures.

MCER NO. 41-97:   PROPOSED REPEAL OF DEPARTMENT OF FIRE AND RESCUE SERVICE REGULATION
                          Fire and Rescue Service Disaster Plan

SUMMARY:  Executive Regulation 41-97 is proposed for repeal because it conflicts with the Emergency Support Function #4 Firefighting Annex of the County’s Office of Emergency Management/Department of Homeland Security’s Disaster Plan, November, 2013.  ER# 47-97 is Montgomery County Fire and Rescue Service Operations Plan that directs the activities of MCFRS personnel during periods of public emergency caused by natural disasters or manmade incidents.  On September 26, 2006, the County Council adopted Resolution #15-1612, The Montgomery County National Incident Management System (NIMS) Policy, and the responsibility for developing emergency and disaster response plans for all County departments, including MCFRS, was transferred to the Office of Emergency Management and the new Department of Homeland Security (OEMHS).  MCFRS existing Executive Regulation #41-97 conflicts with ESF#4 of OEMHS’ new disaster plan and must be repealed .

MCER NO. 01-05AM: PROPOSED REPEAL OF DEPARTMENT OF FIRE AND RESCUE SERVICE REGULATION
                               Medical Standards for Operational Members and Candidates of the
                               Montgomery County Fire and Rescue Service

SUMMARY:  Executive Regulation 01-05AM is proposed for repeal because its procedures, and the NFPA 1582 Edition on which it is based are both outdated.  This Regulation requires all incumbent Montgomery County firefighters/rescuers, both career and volunteer and candidates applying for those positions to successfully complete a medical evaluation that complies with the provisions of National Fire Protection Association (NFPA) 1582 Standard on Comprehensive Occupational Medical Program for Fire Departments, 2003 Edition, with the exceptions of Chapter 8 and Annex C.  This same medical evaluation is used as a guideline only, when applied to all incumbent volunteer emergency medical service providers, and all candidates for those positions.  The Regulation also included a new Section 6, Appeals.  A new policy is being developed that will replace repealed Regulation #01-05AM with current procedures.
