The Office of Human Resources, Class and Compensation Division, and Montgomery County Public Libraries (LIB) requested that the Office of Labor Relations assess, evaluate, and issue a determination concerning the bargaining unit status of the following Office, Professional, and Technical (OPT) unit position, as defined by Section 33-105(a)(2)(A) – (D) of the Montgomery County Code (hereinafter, “Code”), LIB:

This position, unencumbered as of this writing, was reclassified in January 2024, from a Library Associate, Grade 18 to a Program Manager I, Grade 23. Having reviewed and assessed the Position Description for Position No. 005743, and in accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Code, the Chief Labor Relation Officer has determined that this LIB, Program Manager I, Grade 23 position is appropriately included in the bargaining unit pursuant to Code Section 33-102(4) and, consistent therewith, does not fall under any of the exceptions set forth in Section 33-102(4)(A) – (Q) that would compel exclusion from the unit.
 
Any individual or agent of the certified bargaining representative may file an objection to this determination with the Labor Relations Administrator, with notice to the Chief Labor Relations Officer, within 10 days of the publication of this notice:

Having reviewed and assessed the duties attendant to the DHHS, CYFD, ECSU, Program Manager I, Grade 23 position, Number 017047 pursuant to a recent OHR, CCD classification study thereof, and in accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Code, the Chief Labor Relation Officer has determined that this position is appropriately included in the bargaining unit in accordance with Code Section 33-102(4) and, consistent therewith, does not fall under any of the exceptions set forth in Section 33-102(4)(A) – (Q) that would compel exclusion from the unit.

The Office of Human Resources (OHR), Class and Compensation Division, and the Department of General Services (DGS), Director’s Office, requested that the Office of Labor Relations (OLR) assess and evaluate the essential duties of, and issue a bargaining unit determination for the following Office, Professional, and Technical (OPT) unit position, as defined by Section 33-105(a)(2)(A) – (D) of the Montgomery County Code (hereinafter, “Code”), DGS, Director’s Office:
 
Office Services Coordinator (OSC)
Grade 16
Classification Specification No. 009273
Position No. 001120
 
In accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Code, the Chief Labor Relation Officer has determined that the DGS, Director’s Office, OSC, Grade 16 position, No. 001120 is appropriately and necessarily excluded from the bargaining unit, pursuant to Code Section 33-102(4)(E) (“an employee who provides direct staff or administrative support to the head of a principal department, office, or agency, or to a deputy or assistant within the immediate office of a head of a principal department, office, or agency.”). Due to the immediate administrative needs of the DGS Director’s Office, and those of a DGS deputy director, the Position Description for Position No. 001120 (which, as of this writing, is vacant) was modified such that this OSC, Grade 16 position will now provide administrative support for and report directly to a DGS deputy director.

In accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Code, the Chief Labor Relation Officer has determined that the Engineer  III*, DOT, TEOD, Grade 25, Position, No. 003985 is necessarily included in the bargaining unit, pursuant to Code Section 33-102(4), as the position, formerly excluded from the bargaining unit in accordance with Code Section 33-102(10)(B)(which defines a “Supervisor”, in pertinent part, as “an employee with the authority to direct the activity of 3 or more employees”), no longer directs the activities of three (3) or more employees.
