The Department of Housing and Community Affairs (DHCA), Director’s Office, has notified the Office of Labor Relations (OLR) of a change in reporting structure for two (2) Office, Professional, and Technical (OPT) unit positions, as defined by Section 33-105(a)(2)(A) – (D) of the Montgomery County Code (hereinafter, “Code”). In connection with this notification, DHCA has requested that OLR conduct a review of and issue bargaining unit determinations for these two (2) OPT unit positions. They are as follows:
 
Senior Planning Specialist
Grade 25
Classification Specification No. 004402
Position No. 019632
 
Program Manager I
Grade 23
Classification Specification No. 000835
Position No. 018290
 
In accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Code, the Chief Labor Relation Officer (CLRO) has determined that the Senior Planning Specialist, Grade 25 position, No. 019632 (vacant, as of this writing) and the Program Manager I, Grade 23 position, No. 018290 are appropriately and necessarily excluded from the bargaining unit, pursuant to Code Section 33-102(4)(E) (“an employee who provides direct staff or administrative support to the head of a principal department, office, or agency, or to a deputy or assistant within the immediate office of a head of a principal department, office, or agency.”). Due to the evolving organizational needs of DHCA, these positions have been, and are now, necessarily providing ‘direct staff support’ to a deputy director within the DHCA Director’s Office.
 
Any individual or agent of the certified bargaining representative may file an objection to this determination with the Labor Relations Administrator, with notice to the Chief Labor Relations Officer, within 10 days of the publication of this notice:

The Montgomery County Fire and Rescue Service (MCFRS), Office of the Fire Chief, requested that the Office of Labor Relations (OLR) assess and evaluate the essential duties of and issue a bargaining unit determination for the following Fire/Rescue Captain positions:
 
Fire/Rescue Captain, Quality Assurance
Grade B2
Classification Specification No. 003167
Position Nos. 017356.1 and 002521
 
In accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Montgomery County Code (hereinafter, “Code”), the Chief Labor Relation Officer (hereinafter, “CLRO”) has determined that these Fire/Rescue Captain, Quality Assurance, Grade B2 positions, Nos. 017356.1 and 002521 are appropriately and necessarily excluded from the bargaining unit, pursuant to Code Article X (Fire and Rescue Collective Bargaining), Section 33-148(4)(C)(i) and (vi), which provides, in pertinent part, that:
 
                             (4)           Employee means a fire and rescue employee in the classification of Fire/Rescue
                                            Captain, Fire/Rescue Lieutenant . . . but not: (C) a Fire/Rescue Lieutenant or
                                            Captain whose primary assignment is in (i) budget; . . . or (vi) quality
                                            assurance. [Emphasis Supplied]
 
In this regard, a thorough review of the duties attendant to these Fire/Rescue Captain positions revealed that substantial budgetary and quality assurance-related responsibilities are central thereto, and that these responsibilities comprise a significant portion thereof.
 
Any individual or agent of the certified bargaining representative may file an objection to this determination with the Labor Relations Administrator, with notice to the Chief Labor Relations Officer, within 10 days of the publication of this notice:

The Montgomery County Police Department (MCPD), Office of Personnel, has notified the Office of Labor Relations (OLR) of a change in the single part time temporary Cadet position to part-time year-round (12-month career positions (term) with full benefits and increase in salary to the midpoint of grade 10 ($26.03 per hour) with  a reporting structure for positions in the Office, Professional, and Technical (OPT) unit positions as defined by Section 33-105(a)(2)(A) – (D) of the Montgomery County Code (hereinafter, “Code”). In connection with this notification, MCPD has requested that OLR conduct a review of and issue bargaining unit determination for this position which is as follows:

 

Police Cadet
Grade 10
Classification Specification No. 003087
Position No. 18216
 
In accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Code, the Chief Labor Relation Officer (CLRO) has determined that the Police Cadet, Grade 10 position, No. 18216 (vacant, as of this writing) is appropriately included in the bargaining unit pursuant to Code Section 33-102(4) and, consistent therewith, does not fall under any of the exceptions set forth in Section 33-102(4)(A) – (Q) that would require exclusion from the unit.


Any individual or agent of the certified bargaining representative may file an objection to this determination with the Labor Relations Administrator, with notice to the Chief Labor Relations Officer, within 10 days of the publication of this notice:
