The Office of Human Resources (OHR), Class and Compensation Division, and the Department of Health and Human Services (DHHS), Office of the Director Division (hereinafter, “ODD”) requested that the Office of Labor Relations (OLR) issue a bargaining unit determination for a now-vacant Office, Professional, and Technical (OPT) unit position, formerly a non-bargaining unit position in ODD, that was recently reallocated/moved to the DHHS, Chief Operating Officer Division (hereinafter, “COOD”):

Having reviewed and assessed the Position Description for Position No. 019527, and in accordance with sections 33-105(b), 2-25D, and 2-64I ( See Editor’s Note) of the Code, the Chief Labor Relation Officer has determined that this now-vacant DHHS, Information Technology Specialist III, Grade 26 position, as reallocated/moved from DHHS, ODD to DHHS, COOD, is appropriately included in the bargaining unit pursuant to Code Section 33-102(4) and, consistent therewith, does not fall under any of the exceptions set forth in Section 33-102(4)(A) – (Q) that would require exclusion from the unit.
