Miscellaneous Structures in the ROW Permit & Inspection Process
Any miscellaneous structure proposed in the Montgomery County public right of way requires a permit. Typical structures may include park benches, patio seating, wayfinding signs, and other amenities approved as part of a certified site plan. The application will only be considered if the proposed structure was approved as part of a certified site plan. The permit ensures compliance with County Code and public safety. A Declaration of Covenants for Maintenance and Liability will be required that acknowledges Montgomery County’s right to remove the structure if needed and ensures maintenance of the structure is provided by the applicant.

If the proposed work impacts a roadside tree, a permit for tree trimming or removal may be needed. Depending on the scope of work, other permits such as building, electrical, or sediment control may be required. The applicant must also complete a Declaration of Covenants for Maintenance and Liability that will be recorded in Montgomery County Land Records.
A scalable plan showing the proposed structure’s location and associated details will need to be provided. You must also provide a copy of the approved certified site plan. When submitting electronically you will need to meet the ePlans Submittal Requirements for Miscellaneous Permits.
Generally, a permit is issued within 3 – 4 weeks; however, approval time can vary depending on the complexity of the project, the supporting material provided, the applicant’s responsiveness and staff workload.
