Telecom Permits Permit & Inspection Process
A permit for work within the public right of way is required for all construction, reconstruction, relocation or maintenance activities related to telecommunication facilities to ensure the right of way is properly restored and that work is performed in a safe manner. This type of work generally involves minimal trenching to provide telephone, internet, information or data transmitting services. A valid franchise agreement with Montgomery County is required.
- A permit is required for all construction, reconstruction, or maintenance activities performed within the Montgomery County right of way or easements under Montgomery County’s jurisdiction.
- Telecommunication companies providing telephone, internet, information and data transmitting services, and all entities that desire to install any facilities in the county right of way must first obtain a franchise agreement from the county in accordance with the Montgomery County Code Chapter 49.
- If the proposed location is within the State of Maryland or another municipality right of way, you must obtain a permit from that jurisdiction.
If the proposed work is on an arterial roadway (80’ right of way width or greater) or within the Central Business District (Bethesda, Silver Spring and Wheaton) and/or needs sidewalk closure for more than 15 days, the applicant must submit a site-specific temporary Traffic Control Plan (TCP) to be approved by the Department of Transportation (DOT). DPS reviews the individual permit applications and stipulates any special conditions required as part of the approval including the site-specific TCP requirement for other roads not mentioned above. Some types of activities may also require the approval of a Roadside Tree Protection Plan by DPS.
Typically, telecommunication permits are issued within 2 – 3 weeks from submittal depending on staff workload.
Plans must be submitted electronically using the ePlans system. All applications shall be complete in accordance with latest edition of the Montgomery County Specifications for Utility Construction Permit.
