In the matter of the December 29, 2021 police-involved shooting in Silver Spring, Maryland. Pursuant to a Memorandum of Understanding between Howard and Montgomery Counties, which stipulates that when a fatal officer-involved use of force occurs in one county, the other county’s State’s Attorney’s Office will prosecute the matter, Howard County has notified Montgomery County that it reached a conclusion in the shooting of Osman Sesay, 27, of Silver Spring, MD, following an investigation conducted by the Maryland Office of the Attorney General.
The Maryland Office of the Attorney General now investigates all deadly uses of force by officers across the state. The change took effect Oct. 1, 2021, as part of legislation passed by the Maryland General Assembly.
Montgomery and Howard Counties entered into the agreement about the prosecution of police-involved use of force deaths in 2015 following a nationwide recommendation from the Obama Administration. It was formalized with a written Memorandum of Understanding in 2019. The agreement was and remains the first of its kind in Maryland and aims to ensure transparency and unbiased prosecution.
