If a code violation is reported at your property, an inspector will order appropriate corrective action which may include obtaining a permit.
You will need electrical , mechanical , public right-of-way , well , septic, and fire protection permits to complete your new home construction. You will also need to make sure that your project conforms to Zoning requirements.
Many of the subdivision and developments in Montgomery County have private deed restrictions and covenants regulating construction. The County does not enforce covenants and deed restrictions. You may obtain information from your homeowner’s or civic association. You may also need a permit or other permission if you live a Montgomery County municipality that requires it.
New home permits must be reviewed and approved by DPS, WSSC, and MNCPPC. DPS is committed to completing code review within 4 weeks. WSSC and MNCPPC are outside agencies that must complete their review before your permit may be issued.
Please refer the guidelines for information that must be included on your plans.
Please refer to our fee schedule for fee associated with this application type. Please note that new home construction in Montgomery County is also subject to Development Impact Taxes for transportation and schools.
Homeowners may apply for the building permit in their own name; however, if a contractor is to perform the work, DPS strongly suggests that the contractor be listed on the permit as the party responsible for the work. A contractor must have a Montgomery County New Home Builder’s (BC) license to obtain a permit.
Please see our list of required inspections associated with this permit application type.
The Model House Program was established to expedite the issuance of new house building permits. This program establishes a site-specific building permit application process valid for an unlimited number of permits in the current building code cycle. Please see our Model House Program for additional information.
Often a temporary sales office is set up in a model house to allow potential customers to see an example of a home and allow for the contractor or owner to begin the process of selling a lot or a home. DPS has created a policy for this type of use in these types of models to ensure the safety of the occupants.
